BY HERALD REPORTER MARGAO, SEPT 27 — After a three-month suspension of operations, bogies of the sky-bus — Konkan Railway’s indigenously developed technology — begun running on the elevated rails at the Margao railway station. While the movement has caught the attention of passer-bys, KRC officials says the activity is part of the trials to further fine-tune the sky-bus technology. Herald understands that the trials have begun following a report submitted by the expert committee to the Union Urban Development Ministry on the technical viability of the project. It is learnt that the committee has recommended a series of further trials in order to ‘fine-tune’ the technology. Sources said these trials will entail additional expenditure, in addition to the Rs 50 crore spent on the project. Says KRC, Public Relations officer, Baban Ghatge “We have received directions to carry out further trials of the sky-bus. The directions are being implemented”. According to him, the expert committee has submitted its report to the Union government, but the KRC has no details about the findings. Incidentally, the KRC is planning to undertake a series of trials of the project before the Chairman of Railway Board comes down to Margao to preside over KRC Founder’s Day function on October 15. The Union government had constituted a committee after the unfortunate incident last September, wherein the sky-bus rammed against the concrete pillars, killing one person and injuring several others travelling in the bogies. Later in January last, the sky-bus technology came under the scanner of the Commissioner of Railway safety, but KRC has no idea about the details of the report. So far, the 1.6 km test track — world’s first-test track for a sky-bus metro —stands fully completed near the Margao railway station. The test track has cost the KRC around Rs 50 crore and will form part of future testing and certification of various sub-systems of sky-bus metro.

While the jury for feature films has already started working, the non-feature jury begins its assignment on 30th September, 2005. The films selected are first screened at IFFI and then sent to international film festivals abroad in the next one year. The Indian Panorama is the prestigious showcase of Indian cinema in both the feature film and the non-feature film category. Veteran filmmaker Shri M. S. The road tunnel is a part of 250 km approach road network being made by Konkan Railway for enabling construction of the new railway line between Katra and Laole in JK. The road network is a spin off of the main new railway line project in the State. The road tunnel is 396 m long for double-lane traffic. It was made through in about 10 months. Costing about Rs.7 cr, the road tunnel has reduced the approach distance to the Chenab river bridge site by 13 km and has resulted in indirect benefit of almost Rs.30 cr to Rs.40 cr to the railways. The tunnel is supported by steel ribs and concrete. The entire 250 km road network being constructed by railways will be available to locals for approaching the remote areas of JK after the completion of the railway line project. Katra-Laole section is 90 km in length and is the most difficult stretch of the new rail line project as well as any railway project undertaken in the world. It has been entrusted to Konkan Railway due to its expertise in construction of tunnels and bridges. This is a difficult terrain and consists of largely hilly steep slopes intersected by a number of rivers and khads. The challenges in the project are aplenty, reminding once again of the challenges faced during construction of the KR line. The geological challenges, the terrain, the climatic challenges, man-made challenges – all of these have made this a gigantic project. Traditional bullfights, locally known as dhirio and immensely popular with young male spectators and punters in parts of coastal Goa, was halted in 1997, when animal rights groups went to court, asking authorities to take heed of the Prevention of Cruelty to Animal Act. The fights, held in open paddy fields, were deemed unsafe and cruel, as bulls were provoked by trainers before they entered the arena. Enforcing authorities, asked to prevent the fights by the high court, did so for a while. However, the sport refused to be stamped out, and merely went underground. Impromptu tournaments, advertised by word of mouth to its fan pool, have picked up over the years, while authorities lost interest and looked the other way. This month though, the police in a south Goa station called some 40 bullfight organisers to a meeting to warn them against staging the events at the start of its traditional post harvest high season that commences this time of the year. Since then, interest has gained ground, with the local Gomantak Times daily running a series on the views of several fighter bull owners and fans of the traditional animal sport, spurring on a discussion for a more respectable revival. Among its followers in the villages of coastal Goa, fighter bulls enjoy all the fame of race horses, with flamboyant names to go with it. Their owners, many with huge investments in animal purchase and upkeep have unsuccessfully lobbied with politicians from the region to have legal amendments made or fresh legislation to regulate the sport. Since the Prevention of Cruelty Act falls under the concurrent list, the state government could technically make amendments to exempt the sport if it had the political will, one lawyer said. Supporters argue that its regulated resumption would assist better organisation in safe enclosures to ensure spectator safety and vets to treat the animals — a practice followed in other states which host traditional animal sport. Goa’s animal husbandry minister, Mr Francisco Micky Pacheco, himself a fan of the sport, told this newspaper he was attempting to have animal shows started to demonstrate strength and agility. If Mr Pacheco manages to legally revive bull fights — though he has not said so in so many words, preferring to call them animal shows — he will have scored an important victory over rival member of Parliament, Churchill Alemao and other regional political parties who promised to have the sport legalised, in deference to its popularity.

Under the scheme, estimated to cost Rs 40,000-Rs 50,000 crore depending upon the demand for work, the Centre would be contributing 90 percent, while the states would have to pitch in only with the remaining 10 percent for the provision of wage employment to rural households at least for 100 days a year. The Prime Minister said the unemployment allowance which had to be given to those who did not get employment within 15 days of their demand would be met by the states at their own cost. The daily wage under the scheme has been placed at Rs 60 or the minimum wage prevailing in the states, whichever is higher. The unemployment allowance ranges from 25-50 per cent of the daily wage. The provisions of the relevant Act states that “no such (unemployment) rate shall be less than one-fourth of the wage rate for the first thirty days during the financial year and not less than one-half of the wage rate for the remaining period of the financial year”. This guarantee “requires timely transfer of resources to the implementing agencies so that works can start on demand,” the Prime Minister observed addressing a meeting of state ministers of rural development on the National Rural Employment Guarantee Act 2005 here. To prevent corruption and plug leakages in the implementation of the “path-breaking” Act, Singh said the programme should be “transparent”. “The NREG Act must be transparent and truly a people’s programme. Therefore, methods of estimation and measurement of works and rates of payment for each task should be made transparent. The labour that seeks work must understand what is offered, on what terms and demand its full entitlement. “Similarly, there should be complete transparency in maintenance of muster rolls and payment of wages. There should be fairness all around. That is it intention and purpose of this act,” he said. Noting that a guarantee imposed a legal obligation on the state unlike a scheme which is supply driven, he said the task would require a lot of hard work by states such as in creating perspective plans, setting up institutions for monitoring and for providing technical support, designing smooth financial flows and providing for accountability of the entire process. Singh said that the act was a unique social safety net because its beneficiaries were not passive recipients of doles, but will become active participants in the creation of rural assets.

Sources said a panel has given the technology a clean chit, but has called for more work to make it commercially viable and safer. Bolstered by the findings, KRCL now plans to pitch for short-distance projects in Mumbai—for which the monorail is currently the favoured option in some circles—like the Santacruz to Sahar airport terminal. KRCL—with contracts worth Rs 400 crore and Rs 1,500 crore for transport projects in Pune and Hyderabad respectively— is also in the process of identifying partners in both cities under a Build-Operate-Transfer model. In Pune, Skybus is developing a 7.5-km route from the Pune railway station to Swargate and in Hyderabad, it is carving a 22-km route from Uppal to Maslipatnam. Skybus, which was expected to get a boost after KRCL conducted trials on a one-km track at Madgaon in Goa last year, was under scanner following the accident. KRCL officials said a high-level government committee, appointed to inquire into the accident and the Skybus technology last year, presented its report to the urban development ministry in New Delhi recently. KRCL managing director K K Gokhale said the technology was given a clearance but the committee felt further trials were needed to clear required safety norms and for commercially viability. Our technology is sound. There are accidents even in Nasa. Does it mean that the whole project should be abandoned. The committee itself has said the technology should be nurtured,'' Gokhale said. KRCL officials said the inquiry committee had recommended that former chairman and MD of KRCL B Rajaram should be associated with the project as he was the main force behind the Skybus technology. Rajaram retired earlier this year and was not given an extension. Gokhale said: The planners will have to take the Skybus into account on several of the Mumbai city routes. Some sections want to keep us out under the pretext of going in for proven technologies, but in the end they will also have to take us into account.'' New technology needs time to overcome the glitches. When there are accidents in developed countries, they are seen as challenges. Railways across the world have accidents, does it mean that railway technology is defective?''asked KRCL officials incharge of the project. However, transport consultants argued that unlike foreign technologies which are under consideration, the Skybus is not a proven model. The monorail, in comparison, has been used in Europe, Southeast Asia and Japan for over 25 years,'' said an MMRDA planner. It amazes many of us that while the Catholic Church has bent its rules to give saints to other nations, she continues to withold from India, the mother of great religions and land of saints, the honor of having a single fully native Indian Catholic saint. It amazes us that the churches around the world that benefit from the service of Indian Catholics are silent on this lack of Indian Catholic saints. JNVI WHY do we need a *native* Indian Catholic saint? Will having *our very own saint* enable us to enjoy: 1. Electricity supply that is 24x7 and in dire emergencies gets restored in a few hours. 2. Cable TV that is steady and stable (i.e. no sudden switching of channels, hijacking of one channel by another, channels going on and off like a Christmas tree's lights etc) 3. A newspaper guy who can deliver a Mumbai paper latest by noon and not 6:00 in the evening and sometimes the next day! 4. Computer guys who have every intention of keeping their home service appointments. 5. Streets, roads, highways (and sidewalks) that are free of potholes. 6. A beach that is free of litter and not black. 7. A public library that is systematically run and has an uptodate collection of books, periodicals and papers. 8. Long distance connectivity by bus, train or plane that is cheap and cheerful and available on demand. 9. At least one more petrol station where one can get air pressure checked automatically and not manually. 10. Addressing a press conference here today, Dr de Souza said that the councils had been ignoring the provisions of law with regard to the management of solid waste in their jurisdiction and that the Goa State Pollution Control Board would now deal sternly with them, as per law. He said that earlier the Corporation of the City of Panaji and Ponda Municipal Council were issued notices about a month ago for not taking steps for scientific disposal of the solid waste and the rest of the councils would now be issued notices for disregarding the provisions for disposal of the solid waste in their areas. Dr de Souza said that chairperson and chief officer of any council that fails to segregate the waste and set up solid waste disposal plant could face imprisonment which may extend upto five years. He also accused the councils as well as people for dumping solid waste in open areas. The Deputy Chief Minister also said that awareness should be created about solid waste management plants among the people, even as he went on to add that if the problem was not tackled immediately, then solid waste could create an environmental problem all over the state. He further said that the government has to act immediately to solve the problem and added that the previous government should have followed the recommendations of the House committee with regard to setting up of two solid waste disposal plants at Colvale and Balli respectively, but it disregarded it and attempted to set up housing colony on an area earmarked for the plant at Colvale. Dr de Souza said that a seminar has been scheduled on 'Innovating Cities Across the World' from October 11 to 13 and that he would be attending it in his personal capacity and not officially, in larger interest of the state.

Mumbai routinely runs its international flights mostly in the hours before dawn. After all these years, last week there was a demonstration by 100 odd locals at Sahar led by a fellow with a Goan sounding name, calling for a night curfew due to noise levels. The notice, send by Nicholas Almeida, former corporator and a resident of Vile Parle to DCP Shasikant Shinde asks for action to be initiated against airport officials who have been violating the sound pollution guidelines laid down by the Supreme Court. A copy of the notice was also sent to deputy chief minister R R Patil. I've not received the notice yet,'' said Shinde. Said Almeida: The legal notice follows the letter we sent to the DCP on July 26, informing him about the SC judgement on noise pollution. The night operations carried out in the airport is in violation of the Noise Pollution Control Rule 2000.'' If no cognisance is taken within 60 days of the July letter, we will move the court,'' he added. A few weeks ago, Almeida along with over a hundred residents held a demonstration outside the Sahar airport police station demanding that Mumbai airport operations be suspended between 10 pm and 6 am. The argument was that night curfew is observed in most international airports and so it should be followed here as well. The argument hinged on the Environment (Protection) Act, 1986 and Sound Pollution rules which has laid down decibel levels for noise in different areas during the night and day. Though a noise level of more than 45 decibels is not permissible in a residential area during night, a jet aircraft while taking off generates around around 140 decibels of sound at close quarters and about 100 decibels in surrounding areas. Since most international flights take off from Mumbai airport in the wee hours of the morning, the protesters deemed it to be a violation of the Supreme Court guidelines. The Mumbai airport runway, which sees about 500 landings/take-offs a day has no such noise monitoring gadgets, nor do they have plans to install any in the future.

He wants a ban on movement of flights at night saying the noise disturbs people living near the airport. Mumbai has two airports, one for domestic and another for international flights, located near Sahar village. A noise level of over 60 decibels (dB) is harmful to the ears. We have to bear noise levels of over 140dB. When big international airports can ban night flights, why not Mumbai, said Almeida, a social activist and a former municipal councillor. Many of us have become insomniacs due to lack of peaceful sleep at night, he said. Several complaints to the police have fallen on deaf ears. On September 13, 200 residents organised a morcha to the local police station demanding a ban on flight movement between 10pm and 6am. On September 20, Almeida issued a legal notice (a copy of which is with the Mumbai Mirror) to Deputy commissioner of police (DCP) Shashikant Shinde, who is in charge of the airport zone, demanding action within 7 days. When contacted, DCP Shinde refused to comment. However, Airport Director Sudhir Kumar was clear about the consequences of such a ban. Several European countries have banned night flights. Owing to the time difference in the two continents, flights from India can land in Europe during the day only if they take off at night. Hence, a ban would be impractical. The study will be conducted by Konkan Railways with the funding from Doxport consortium, which was formed to promote Skybus technology that was developed by former managing director of Konkan Railways, B Rajaram, across the globe. The Andhra Pradesh government gave permission to undertake feasibility study for Skybus technology-based mass rapid transport system on Mehdipatnam-Uppal route in March, 2005, without offering any firm commitment on adopting the system as it was yet to be tested. “The Skybus technology is an alternative to all the existing metrorail mass rapid transit systems around the globe,” Rajaram said in a press conference, adding that this indigenously developed technology outperforms all other systems on all important counts, including performance and cost. While I hold no brief for the Monorail, it perhaps needs to be recalled that the Konkan Railway itself grossly under-estimated its costs at the time of pushing through the project (literally, thanks in part to George Fernandes and Madhu Dandavate and the upcoming elections in the early 'nineties) at a little over a thousand crores... to end up at six times or more that cost. Overall, it may be a proposal with merit but people need to know whether the traffic generated between the three cities is adequate in terms or viability to keep this mode of transport afloat, or whether it would end up as another white elephant like the Skybus project. In a press release the KCCI stated that the trials made by KRC confirmed that Skybus would be an ideal urban transport mode. However there has been a problem of bringing Skybus under a particular authority since it is not yet confirmed whether it is a train or a tram. The KCCI stated that Skybus is a unique concept and it is a hybrid between train and other modes of rapid transportation. But it is very important to determine whether it comes under the Railways Act of Tram Act since it requires to be validated for public use and safety. The KCCI further stated that if it is neither a train nor a tram it can be brought under any enactment as a special device and later validated for use. So the KCCI has urged the Urban Development ministry to intervene on behalf of KRC and bring the proposal to appropriate authority for consideration of inclusion since KRC is already ready with the model. KCCI has further made a request with the ministry to consider the prospects of introducing Skybus to relieve congestion and provide a viable alternative in a medium sized city Mangalore, since it feels that Mangalore city will be eligible for the introduction of Mass Transport by the year 2010. KCCI has also appealed the ministry to commission a pre-feasibility study on introduction of Skybus into Mangalore city from Ammembal to Haleyangadi, the South East and North West corners of Mangalore city covering a distance of 25 kilometres passing through the centre of Mangalore city. Allocation to residential and commercial purposes put heavy pressures on land for public use like parks and open spaces apart from very important and critical roadways. Hardly 6% to a maximum of 18% of land in cities form roadways. The roadways once laid- almost remain constant – at best- and may effectively reduce by uncontrolled encroachments. The physical constraint of road area being constant, as population increases, naturally loads on roads increase. As more and more people from different habitats try to converge on to the central business district, the road has no capacity to handle and congestions erupt. Roads take one exactly to the point where one wants to go. But the capacity is limited in terms of passengers per hour that can be handled. Even if one considers only buses, need to maintain the braking distances between two buses and the space maintained between them affects speed as well as limits per lane what capacity can be achieved. When mass transit , that too at higher speed is required, rail based systems only can handle. Requirements of an ideal urban transport system: Heavy concentrations of residential units coupled with required movement to work places or to market places demand transportation of people. Roads are to cater for the same. But roads have a limitation- the area available remains constant, once the development is completed, and old cities in particular throw up the problems of mismatch of designed capacity versus the increasing pressure of populations. Let us examine the various modes of transport that population uses in a city and their capacities and limitations, to evolve requirements of urban transport solution in a holistic manner. Currently available solutions are either elevated railway or underground railway if mass transportation is required: Elevated railway technically cannot reach truly congested central busy roads where the mass transport is needed. It is also too invasive and may require dislocation of some portions of habitat as well as introduces noise pollution. Underground railway is less invasive on surface but still poses technically challenging risks of fires and evacuations. It also has to address concerns for foundations of heritage buildings. If road vehicles are involved, in inter-modal transfers, it becomes weak link in the chain of transport between walking and railway. Both modes suffer from derailments and capsizing killing commuters. Surface railway is impossible to lay in an existing city. But even to lay the same in a new development, one should keep in mind what happens after 50 years of laying the same. We have living example of our own suburban system. The city remains divided by the corridor and it is an eternal noise polluter in the heart of city day in and day out. Sudden disgorging of heavy loads of commuters at stations create need less congestion on the roads, reducing quality of life. Almost close to 2000 persons die annually- because of trespassing or falling from trains in our present system- whatever be the excuse and justification for accepting the same. In addition vulnerable to minor vandalism by urchins, but resulting in grievous injuries like losing sight for the commuters. Again this mode cannot follow roads, so the weak link of road vehicles has to be brought in for inter-modal transfers. Derailments, collisions and capsizing concerns remain with loss of life for all the above mentioned three systems. The infrastructure created for urban transport is hardly utilized to 30 to 40% capacity because of directional as well as inevitable peaks for limited hours in a day. It has no other use and just idles. An ideal solution is one which: 1. Follows the existing roads- but does not take road space- and be as flexible as a bus 2. Have rail based mass transit capacity, same as existing rail metro 3. Does not divide city while providing integration along its alignment 4. Be derailment and collision proof- with NO CAPSIZING of coaches- so that there can never be loss of life 5. Be free from vandalism 6. Noise free and pollution-free 7. I believe he was on a respirator or maybe heart-lung machine at the Lilavati Hospital in Bandra, and earlier to that at a Malad hospital. He was a resident of Malad. I am not aware of the details, such as TOI insurance, etc. I didn't query my friend about all this. We were talking about the death and the funeral. Hearing a public interest litigation filed by an NGO called Project Smita, a division bench of Chief Justice Dalveer Bhandari and Justice S J Vajifdar directed the authorities to submit the list by August 22, when the court would next hear the matter. The PIL was filed by Bollywood filmmakers Mahesh Bhatt, Soni Razdan, Ashok Pandit, Vinta Nanda and ad guru Alyque Padamsee. “The city was unprepared for the disaster. That was the reason for the loss of lives and property,’’ said the judges. “Unfortunate events like this may not recur but still we have to come up with a disaster management plan.’’ The judges also remarked that the weather bureau would have to consider setting up sophisticated equipment for forecasting. Majeed Memon, counsel for the petitioners, submitted a list of 42 NGOs. The court has directed the state to take their assistance for rehabilitating flood victims. Meanwhile, BMC counsel K K Singhvi assured the court that there was no epidemic in the city or suburbs and the corporation was providing adequate medical aid to victims. Singhvi’s appeal for a gag order on the media publishing personal articles on BMC commissioner Johny Joseph was rebuffed by the judges. The court has asked the state, BMC, the Centre, the meterological department and the railways to reply to other issues raised in the PIL in three weeks time. The petitioners have sought compensation for victims, implementation of a disaster management plan, upgrading storm water drains and improved coordination between different government agencies. Western Railways (WR) lost around Rs 12 crore. Of this, Rs 7 crore was owing to repairs in suburban rakes, Rs 1 crore owing to damage to tracks, signals and electric poles. The rest accounted for ticket refunds as around 130 Gujarat and Delhi-bound trains were cancelled between July 26 and 30. We have planned to restore normalcy by the month-end. By August 20 there will be complete normalcy, said Shailendra Kumar, spokesperson for WR. Of the 250 services between Virar and Churchgate, 70 per cent are running, and most of the 12 coaches are cut short to 9 coaches. Till now only 50 per cent of the 12 coaches trains has been restored. It will take another week for the trains to operate in full swing. The 1,007 train services which western line runs in a day were hit because of the 26 damaged EMU rakes and signalling systems. Seventeen of these have been brought back into service, while 9 rakes are yet to be repaired, he added. Central Railway (CR) was equally hit by the floods. Of the 94 EMU rakes which run on the suburban lines, 49 were damaged. 32 of them have till now been restored. This alone has cost CR Rs 27 crore. This has affected the frequency of locals. To ease the burden of passengers, the central suburban railway is running shuttle services in the peak hours of the day on CST Thane-Kalyan route. These services will operate till all the rakes are back on the tracks, said A K Singh, PRO, Central Railway. The overall loss to the Central railway has been estimated around Rs 80 crore. The refunding back of the tickets has cost Rs 15 crore. CR has been the worst hit in terms of train cancellation as tracks in its north-east and south-east sections were washed away. Trains were cancelled from 26 July onwards. However, because of the excessive number of cancellations the exact number is not known, Singh said. About 1,200 metres of track between Ambivli and Titwala, Ambarnath and Badlapur was completely washed away. The losses suffered by CR owing to the floods was estimated at Rs 80 crore. We expect to return to normalcy within a week, Singh said. On Monday this week, 74 EMU rakes and 8 trains with second-class coaches were put into service. Of the 1,203 CR services, 975 have been restored. The Konkan Railway kept all of its trains, heading to Mangalore, Kerela and Goa, cancelled till Monday. Four trains were restored on Tuesday and the rest will be on the track by today, said an official at Konkan Railway. The loss suffered by Konkan zone has been mostly because of the cancellation of trains. It is around Rs 6-7 crore and the refunding back of the tickets has cost us Rs 1 crore. Many of the railway staff colonies in areas such as Mangaon were completely washed away causing personal damage, said Vaishali Patangi, PRO, Konkan Railway.

Mumbai, Aug 8 (UNI) The Konkan Railway today short-terminated two trains that had departed from Goa and Ratnagiri to Mumbai as restoration of track work near Nagothane of Central Railway was yet to be completed. The Mandvi Express was terminated at Ratnagiri railway station, while Ratnagiri-Dadar Passenger was terminated at Madgaon (Mangaon ?) railway station, official sources said here today. The track is likely to be restored by tomorrow, sources said, adding that the ''Track fit certificate'' had not been received yet. Mapusa police arrested Rosario Fernandes (61) and Terezinha Fernandes (58) in connection with their daughter's murder after Perpetua's sister-in-law Apolonia Fernandes, who was arrested on Thursday, told police that Rosario cut his daughter's neck with a chopper, while Terezinha and herself (Apolonia) attacked Perpetua with knives. DySP Waman Tari and PI Sandesh Chodankar disclosed that on that fateful Tuesday night, Perpetua's parents left her residence as usual at 10.30 pm. However, around midnight, they returned along with Apolonia and murdered Perpetua. Police further informed that broken pieces of red-coloured bangles were found under the body of Perpetua. The bangles match with those worn by the deceased's mother Terezinha. The police also claimed to have seen bloodstains on the clothes of Rosario. Though the exact motive behind the murder has not yet been established, the police put it as an enmity between the accused and the deceased. There were several police complaints and counter-complaints between the accused and the deceased. Police have recovered three gold chains, three rings, a pair of earrings, a bracelet and a pair of bangles hidden by Terezinha on her person. All three accused have been remanded to four days police custody. -

The track on the Panvel-Roha section of Central Railway was cut into two when rain washed away the ground beneath. Principal Chief Engineer Subodh Jain, who toured the site along with journalists on Wednesday said, Right now we will construct a temporary bridge for the movement of trains. Train movement should resume by August 6.'' The track which runs parallel to the Mumbai-Goa Highway had been submerged in the downpour which also damaged homes in the neighbouring village of Pandarpur. While the railways have been working overtime to fix the damage, CR officials say a major disaster was averted due to the alertness of a staffer patrolling the section. It was he who informed Kasu railway station about the tracks being washed away. The Rajdhani which left Mumbai on July 25 was to pass the track. The patrol man Murgesh informed the station master and the train was halted at Kasu,'' said Jain. Murgesh, a CR employee for the last 22 years, does not make much of it though. He says he was merely doing his job, but he is happy that he was able to save some 400 passengers. I was patrolling the area checking the tracks and its fittings. I saw water gushing onto the tracks and knew it would soon be wiped away. -

The Supreme Court verdict clamping down on the use of loudspeakers after 10. p.m. would be welcomed by all. After all, who wants to have an perforated eardrum at the time of going to bed. The SC has also banned the use of car horns in all residential areas from 10 p.m. to 6 a.m. with immediate effect. The Supreme Court has also decreed that functions and weddings will have to ensure that they keep noise levels below 75 decibels in designated public places and also operate loudspeakers during the designated hours. Noise pollution, in this boisterous and raucous country, is something we tend to take it in our stride. So the SC clamp down is welcome. But there one is disturbing twist in the tale. Quite simply, the end is acceptable, but not the means. In other words, the use of court to legislate is not on firm ground. Does Indian constitution bar freedom of expression beyond 10 p.m.? Since it does not, the court has no authority to make this ruling. This is an erosion of democracy. Courts are not elected by people. Hence, they should just arbitrate. They should not legislate. On the face of it, this might seem to be a silly quibble. You may very well ask if a good is coming, why argue over from whom it is coming. In this case, it is just noise pollution, and it is easy for all of us to find a common ground. But what happens when bigger and weightier issues are at stake? An Ayodhya, for example. Too often, there is a desire to use the courts to achieve political ends deemed 'correct'. But there will always be a flipside to it, and we will understand it soon to our peril. Make no mistake. Some day there will be a bigger price to for granting the judiciary such unchecked and, arguably unconstitutional authority. Recently, a US Court, in a matter on the right of a municipality to appropriate private homes in the interest of economic development, ruled in favour of the municipality. Obviously it has not gone down very well. If this can happen in the US, where private property has long been considered sacrosanct, it can happen anywhere. Courts in, say India, could cite the US decision to interpret their legislations. The point is courts can create favourable social outcomes by using their judicial power to, in effect, legislate, but it's far better to achieve the same using political means in the designated legislature. Absent that, people risk losing more politically than they gained in court. People, through their elected legislatures, should make this judgment instead of unelected judges whose personal political biases will surely influence their judgments. In a country like India, where public interest litigations are so popular and the courts are much too activist, this is something to keep in mind. But the political system in the country has thoroughly discredited itself. People no longer seem to have faith in it. They seem to vote more out of a sense of duty or even practice, but have no expectation from whatever dispensation that comes to power. In such a situation, the courts tend to step into the breach. The watchman may be doing a good job and the head of the family may be lousy. That doesn't necessarily follow that the watchman should be made the head of the family. - NT Bureau

In an order that would render late night marriage processions and political rallies shorn off sound and fury, a Bench comprising Chief Justice R C Lahoti and Justice Ashok Bhan yesterday said no loudspeaker could be used in the specified period of the night except in public emergencies. Putting restrictions on the use of loudspeakers even during the day time, the CJI, writing for the Bench, said the decibel level of the megaphones or public address system should not exceed 10dB(A) above the ambient noise standards for the area or 75 dB(A) whichever is lower. Coming down heavily on those who play loud music at home as a show off, the apex court said the noise polluters have no regard for the inconvenience and discomfort of the people in the vicinity and chastised them saying no one can claim a right to create noise even in his own premises which would travel beyond his precincts and cause nuisance to neighbours and others. Mater Dei Institute had its own ground while others played foot-ball in the fields and level hilly terrain. During my younger days I witnessed even hockey and cricket matches being played in Saligao. However foot-ball was the most favourite game of the boys. Other games seasonally played were---cashew seeds games, marbles, tonko-bal, collie, fovio(mixed boys and girls) and the indoor games tablam, five stones,( mostly by hindu women and girls with some exception among christians), konxeamnim etc.My research identified more than twenty traditional games. However youngsters, teen-agers with whom I inter-acted lately do not seem to know much about these games which we played in forties, fifties and sixties and little beyond. Cable TV is also responsible for the decline of these games as I saw most of our young boys and girls glued to the idiot box and also tuitions which is a craze in these days due to competitions in securing entry into colleges and institutes of higher learning. Summer time was supposed to be the most ideal time to indulge in outdoor games. In the following postings I shall give a brief description of some of these games. BIYANI ( Cashew Seeds Game) In the months of April/May till the beginning of monsoon, Biyani or cashew seeds games were played on the long stretch of the red mud roads when there was hardly any cars or heavy vehicles passing. Occasionally we saw a bullock cart or a gaddi( match box as it was called locally) or a cycle making rounds on these roads. Mode of Playing: a) A mark was set at a distance of about twelve to fifteen feet away. Each player had to throw a seed nearest to mark to get their turn first and the rest accordingly after. b) Each player had to contribute two or three seeds. All the collected seeds for that game were placed on a slightly raised mud row called Uri and a boundry line was marked around the Uri. The seeds were placed horizontally on the Uri except one on the extreme left was placed vertical. c) The player whose turn is first, standing about twelve to fifteen feet away from the Uri stikes at the seeds with a BOTO( striker). If he strikes the main seed( Vertical) outside the boundry line around the Uri, he is entitled to all the seeds on the Uri, otherwise only for those seeds struck out of the Uri boundry. The remaining seeds inside are re-arranged for the next player till all the seeds contributed for that game are won. Then they wound begin a fresh game( I regret for not providing a diagram, which I possess). BOTTO. The largest dry cashew seed is selected. In the navel( center) of the seed a small hole is bored and with some sharp and pointed contrivance the inside kernel is scraped out. Into this hollow of the seed molten led is poured in through the hole. The seed then becomes heavy and is used as a botto( stiker) for playing the cashew seeds game Fr. Being Indian: The citizenship question TIMES NEWS NETWORK[ MONDAY, JANUARY 10, 2005 12:08:36 AM ] How does one become an Indian citizen? Articles 5 to 9 of the Indian Constitution deal with the issue of who was entitled to citizenship at the time when the Constitution came into being. Article 9 stipulates that any Indian citizen accepting citizenship of a foreign country automatically ceases to be an Indian citizen, Article 10 guarantees the continuance of citizenship once acquired and Article 11 clarifies that Parliament will have the right to regulate citizenship. The Citizenship Act, 1955 details the various ways in which a person can become an Indian citizen after the commencement of the Constitution. Essentially, this is possible either by virtue of birth, descent, by registration or naturalisation. The Citizenship Amendment Act of 2003 added a further category of overseas Indian citizens, who however will not have all the rights of full-fledged citizens. Does being born in India automatically make you an Indian citizen? Not quite. It depends on when you were born. Under the 1955 Act, a person born in India on or after January 26, 1950 and before July 1, 1987 is a citizen by birth irrespective of the nationality of his parents. If you were born in India on or after July 1, 1987 and before January 7, 2004, at least one of your parents must have been a citizen of India at the time of your birth for you to qualify as a citizen by birth. Those born in India on or after January 7, 2004 are citizens by birth only if both parents were citizens of India or one parent was a citizen and the other was not an illegal migrant at the time of their birth. **How does one acquire Indian citizenship by descent? Again when you were born matters. A person born outside India on or after January 26, 1950 but before December 10, 1992 is a citizen by descent if his father was a citizen at the time of his birth. For those born outside India on or after December 10, 1992 and before January 7, 2004, either parent being a citizen at the time of their birth confers citizenship by descent. Those born outside India after January 7, 2004 are not citizens, unless their birth was registered at an Indian consulate within a year of the date of birth or, with the permission of the government, after the expiry of that period. Who can acquire citizenship by registration? Citizenship by registration can be acquired by: persons of Indian origin (PIOs), who or either of whose parents was born in undivided India and who are ordinarily resident in India for seven years; PIOs who are ordinarily residents in any country or place outside undivided India; persons who are or have been married to a citizen of India and who are ordinarily resident in India for five years; minor children both of whose parents are Indian citizens; citizens of Singapore and Canada who are resident in India for five years and eight years respectively. How does one become a naturalised citizen? Citizenship by naturalisation can be acquired by a foreigner who is ordinarily resident in India for 12 years (continuously for the 12 months preceding the date of application and for a total of 11 years in the 14 years preceding the 12 months). Can citizenship be terminated once it has been acquired? Yes. Under Section 9(1) of the 1955 Act, a person ceases to be a citizen of India if he or she voluntarily acquires the citizenship of another country. Also, under Section 10, anyone who has become a citizen of India by naturalisation or by registration due to marriage to an Indian citizen can be deprived of the citizenship by the home ministry for certain reasons.

Have found *ROBAN*, available at the local pharmacy (Margao, Mapusa), quite effective. The cakes' are priced about Rs.15/- a pack... not sure now. Supposedly harmless to humans and pets! Apparently, after 12/24 hours after ingestion of this poison, the rats suffer internal bleeding and die. But the effect of the poison also causes them to run out into the open, towards light. Hence no dead rats/mice in inaccessible places behind furniture or on the roof...and mercifully no stink. God bless the people who concocted this remedy.
