Re: [videoblogging] Shooting In Public
- Original Message - From: Mark Villaseñor Richard Amirault: If this `helmet cam' incident happened in Massachusetts it would seem that it would be a violation. Under the same fact pattern, no it would not. Graber's video recording was not surreptitious, done with sinister motive, posed no public harm and was a continuation of lawful conduct engaged on public lands BEFORE the police officer stopped him. Consequently criteria established under Mapp vs. Ohio make the evidence worthless; there are no two ways about that. Sorry, a very good case can be made that the recording *was* surreptitious. Yes, it was in plain sight. BUT was it obvious to the officer that it was a recording device .. and, I think more importantly, was it obvious that it was in record mode? Re: [videoblogging] Shooting In Public
- Original Message - From: Mark Villaseñor (snip) On March 5th of this year Anthony Graber drove his motorcycle recklessly, until being pulled over by a Maryland State plainclothes policeman. Graber wore a GoPro HD helmet-cam, recording his antics prior and after the police stop. He was on a public highway, in clear daylight and the camcorder was in plain sight (GoPros are rather bulky and VERY obvious, if you've never seen one). After the incident Graber posted his vid on YouTube, including scenes of his stop by the policemen. (snip) So the paragraph above is misleading. ... recording his antics prior and after the police stop. By after the police stop I took it to mean after the stop was finished and done and he was on his way again. I could also mean after the police stopped him, which is what happend as we read the next paragraph. Despite being in plain sight, and very obvious, how obvious was it that it was in 'record mode? Unless he stated verbaly that his conversation with the officer was being recorded (giving the officer the chance to order him to stop recording) they may certainly have a valid case (depending on state law). You *can* photograph and video record from the public ways. You (in many states) cannot record the audio of conversations without permission despite the location. Re: [videoblogging] Shooting In Public
- Original Message - From: Mark Villaseñor Howdy Richard: Irrespective your critique of my prose (so sorry I confused you, my bad), I respectfully disagree. Please bear with me while I explain..? 18 USC §2510 and related parts define what wiretapping is and is not, and Graber's actions do not appear to meet that criteria. Subsequent federal law also defines the common term, Single Party Consent in relation to subject matter; and, in Mapp vs. Ohio (1961) the U.S. Supreme Court ruled, in part, that states have no right to abuse the Fourth Amendment (even when a Search Warrant is otherwise lawfully granted) when other Constitutional elements are in play (and they are here; Graber is a YouTube video blogger, which is also protected conduct as PRESS under the First Amendment). Graber had no obligation (whatsoever) to disclose whether or not he was recording, both parties were in a public place not providing any expectation of privacy as supported by relative case law. Moreover of the thirty-eight (38) states and D.C. that have wiretap laws on the books, few have sought to test issues beyond Constitutional limits (because most fail miserably in the doing). Well, I'm no lawyer .. but I do know that the law is (can be) different in various places unless superceded by federal law. The following is a partial quote from a website I found: === In Jean v. Massachusetts State Police, police officers conducted a warrantless search of Paul Pechonis's home. (1) Unbelmownst to them, the search was audiotaped and videotaped by a nanny-cam. Pechonis later gave the recording to Mary Jean, who posted it on her Web site with commentary criticizing the local District Attorney. The officers claimed that Jean had violated state law by willfully disclosing the contents of a recording made without their prior consent. (2) They ordered Jean to remove the recording. (3) The district court granted Jean's request for preliminary injunctive relief and the First Circuit affirmed, concluding that the First Amendment likely protected Jean's disclosure of the recording. (4) However, the First Circuit implied that Pechonis had violated the Massachusetts recording law. (5) Massachusetts and at least twelve other states criminalize recording a communication without the knowledge or consent of all parties to the communication. (6) While some of these states' laws could be construed to exempt some recording of police, (7) others offer no textual basis for such an exemption. (8) Citizens in several states have been arrested, (9) and in some cases convicted, (10) for taping police conduct. This Comment argues that citizen tape recording provides a necessary check against police abuses of power and furthers privacy values underlying the Constitution and other laws. But police officers' interests in privacy and safety must be balanced as well. Therefore, states should permit citizens to record police officers in the line of duty without those officers' consent, as long as their recordings are made in a physically unintrusive manner and do not capture police communications that police could reasonably expect not to be recorded. I. THE STATUS OF STATE RECORDING LAWS Massachusetts and a number of other states prevent citizens from recording police officers' conversations, even within citizens' own homes. Massachusetts itself broadly prohibits the willful secret[] record[ing] of any wire or oral communication by any citizen without the consent of all parties to the communication. (11) Accordingly, Massachusetts's highest court has refused to exempt citizens who record police officers, even when the recording captures alleged police misconduct. (12) As the First Circuit recognized, the First Amendment protects individuals like Jean who distribute recordings of illegal police conduct. But it probably does not protect individuals like Pechonis who produce the recordings. In Bartnicki v. Vopper, the Supreme Court suggested that disclosure is protected when it constitutes the publication of truthful information of public concern. (13) The Court explicitly declined, however, to protect obtaining the relevant information unlawfully. (14) Furthermore, [t]he First Amendment [does not become] a license ... to intrude by electronic means ... simply because the person subjected to the intrusion is reasonably suspected of committing a crime. (15) Thus, the Amendment does not excuse citizens from state liability for recording police, even where citizens allege police misconduct. === I remember a case (which I could not find on-line just now) where a man recorded, with a visible audio cassette recorder, the police stopping him for something or other. As far as I remember he was later convicted of some sort of wiretap violation because he did not get the officers consent. This was in my state of Massachusetts. I don't necessarily agree

I also found this clip by Bill Myers http://www.youtube.com/watch?v=I1VkY6v3Ll4 that may help me. I am going to give it a whirl this weekend! Good luck. I checked out that clip. I've never done it that way, but it certainly would be better than actually cutting out portions of the upper tracks because it is a *lot* easier to restore something if you decided that you've made a mistake .. or you could have done it better. However, that clip is only *after* you have synced the tracks (which he does not show) Now that I have Vegas Pro I can use it's multi-cam edit mode which is even easier (not part of Vegas Movie Studio) Richard Amirault N1JDU http://bostonfandom.org
Re: [videoblogging] Sony Vegas Movie Studio Editing Question
- Original Message - From: Marguerita Greetings, I bought a second camera (used, cheap on Craigslist) to help me make better videos and I just tried editing two simultaneously filmed small clips. There must be a better way! I am learning as I go and the only way I could figure out how to do this was to put both clips on the timeline, take excerpts from clip#2 and overlay them onto clip#1 - but I had to play around with placement because the time marker just treats the clips like one long clip on the timeline. I had to read lips to make sure I placed it in the correct spot to match the sound. I was hoping for a way to edit both clips simultaneously on the same timeline - I sure hope that makes sense. I could line the 2 vids up with a clapper, but I need to see them both at the same time to decide which one overlays the other. Is this possible? One of the best ways to sync video is to sync the sound. Put both clips on the timeline. One above the other. Expand (left/right) the timeline so that the audio waveform is easier seen. Slide one clip left/right until it matches the other clip. Test it by muting the audio from clip A put viewing the video of clip B. Once everything is synced, LOCK both to each other. There are fancier ways to edit the resulting video, but one way is to cut out sections of the top video where you want to show the bottom video (be sure that you shut off Ripple Edit) Richard Amirault Boston, MA, USA http://n1jdu.org http://bostonfandom.org http://www.youtube.com/watch?v=J7hf9u2ZdlQ

I will say this, based on my experience over the last year, which is that our society needs to have a lot more conversation about death. Re: [videoblogging] Lighting
- Original Message - From: David Jones I'm starting a new blog idea and need some extra lighting. Many segments will be based indoors in a poorly lit room, talking head style against an open glass window with daylight outside and a laminated poster stuck on the window behind them . The light from outside is good, good?? Seems to me it's pretty bad It's giving you problems .. some you haven't even discovered yet. but of course the subject with their back to the open window will be in shadow due to the poor room lighting. So I need some spot lighting in order to light up the subject evenly. I figure ever massive lighting behind the camera to light up the whole room, or some smaller diffuse spots on either side of the subject up close and just out of shot on two tripods (hopefully no reflections form the laminated poster). Anyone have any experience in this sort of situation? You didn't say what direction the window faces (N,S,E or W) Does direct sunlight enter the window at all? Mixing natural and artificial light can give problems with color balance. You may need considerable artificial light to overcome the brightness of the outdoor light. If your indoor light is balanced for tungsten then the outdoor scene will have a distinct blue tint. Better would be lights balanced for daylight. Better yet, IMHO, would be to loose the window altogether .. things would be a *lot* simpler. Richard Amirault N1JDU http://bostonfandom.org

- Original Message - From: Kevin Lim Hello Cheryl, I'm in the amateur category, so my budget has typically been below $400. I ended up with the Sanyo Xacti HD1010, which is the 2nd gen to HD1000, with the newest being HD2000. What's nice about this series is the MPEG4/H264 video format which is native to the Mac as well as video sharing sites like Youtube and Vimeo. I also like the fact that for a camera under $400, it allows for audio line-in and interchangable lenses. This camera just made a lot of sense to me. I just did a quick check and I don't see that this has interchangable lenses .. nor does it sell under $400 .. at least normally. Richard Amirault N1JDU http://bostonfandom.org

See http://en.akihabaranews.com/19049/image/little-things-make-a-difference-xacti-hd1010-1000-lenses Hmmm ... those lenses are *accessory* lenses, not main lenses. In other words they screw on to the front of the existing lens. They work, but not as well as a real lens .. as in a SLR or DSLR of the same focal length. Interesting that the main Sanyo site for this camcorder does not mention those lenses (at least that I can find) .. I did find them listed as accessories for the camcorder at BH Photo. Also interesting to note is this camcorders manual settings: The HD1010 features versatile manual controls for advanced shooting. The following settings can be manually adjusted according to the shooting situation: Manual focus adjustment (16 settings); aperture adjustment (6 stops); exposure compensation (1.8 EV, 0.3 EV steps); shutter speed (13 settings); and image-quality adjustment (for sharpness and color saturation). And the 7 frames per second single frame shooting mode. Richard Amirault N1JDU http://bostonfandom.org

Re: [videoblogging] boom pole
- Original Message - From: Loreta_Vaidas Can anybody please recommend a good quality (not too pricey please) boom pole for a one person team? I don't understand what a one person team is. A team, by definition seems to be a minimum of two. I have an Audio-Technica AT875R shot gun mic which I'll be using for my videofilmings and would like a boom pole to go with it. Holding a pole myself is not an option. A boom pole holder may work. http://www.bhphotovideo.com/c/search?Ntt=boom+pole+holderN=0InitialSearch=yes but only for a subject that is not moving about. Please give me some guidance what features to look for in a pole, where and what best to purchase, etc. Some poles have the mic cable built-in, and of course the length varies. You can always go with the Home Depot / Lowes extendable paint pole. But you will need to purchase an attachment to convert the end to hold the mic. http://cgi.ebay.com/Make-mic-boom-pole-w-adapter-4-rode-other-microphones_W0QQitemZ220557427871QQcmdZViewItemQQptZLH_DefaultDomain_0?hash=item335a3f449f and, of course, this also requires you to run the mic cable the length of the pole. If you are shooting outdoors you will definitely need a windscreen. The foam type may work well enough, or it may not. Better is the furry or dead cat type of windscreen. Even better is a blimp type with a furry cover. If you have a person to hold the mic/boom pole be sure that they have headphones and can actually *hear* the audio from the mic. Otherwise they won't know if they are holding the mic / pole properly. This may be a long cable running out of the camcorder to the person, or .. you can do double system sound and record to a high quality digital recorder. In that case the recorder can be carried by the boom pole operator and and there is less chance of someone tripping on a long cable from the camera. You will need to sync-up the sound in editing, but it's not as hard as you might think. Richard Amirault N1JDU http://bostonfandom.org

Re: [videoblogging] Re: Youtube thumbnail frame
- Original Message - From: Vaidotas Thanks everyone for replying to my message. Yes, I figured there's no way to get my own thumbnail frame besides the 3 offered by Youtube. Kevin, what do you mean by inserting the poster frame in the middle of a timeline? You mean it's not hidden anyhow? I can't imagine putting a certain frame in out of nowhere in the videos for clients. Unless it's really suitable. (snip) YouTube chooses a frame from the exact middle of the video timeline for the second choice. I don't know exactly where the first and last choice are taken. Obviously it is somewhere near the beginning and the end of the video. What about figuring out how far in from the end those first and last thumbnails are (you'll have to look on YouTube and then try to find those frames in your Vegas timeline) .. then .. make whatever thumbnail you want .. and add it to the *end* of your existing video so that it will be chosen as the third choice. I would make an extended still frame selection, not a single frame insert, to maximize your chance of it getting picked by YouTube. You could even fade to black before you add the thumbnail image at the end .. so that 99% of those watching will click away before the image comes up .. and even if they don't click away .. I don't think it would be a problem. Richard Amirault N1JDU http://bostonfandom.org

Re: [videoblogging] Microphone hiss, need advice...
- Original Message - From: pageflex2001 I noticed a microphone hiss in the last video I made ( http://bit.ly/dzPTGe ). If you listen closely wearing headphones while watching this video you will notice a hiss that is very annoying.. Very few people will listen closely wearing headphones while watching videos on YouTube. I was not going to sit thru 26 minutes but the part I watched (heard) I could not hear any hiss ... I would think the background music would cover any low level hiss. The mike I used for this vid is Electrovoice 635A(B). I was wondering if anyone can recommend a hissless mike that is unidirectional (captures only the talker not the background) with XLR input. Any help is truly appreciated.. That was a 635 with a *lot* of experience ;-) BUT .. those subjects were not mic savvy .. they did not know (or if they did .. they did not care) how to properly hold the mic. Sometimes it was OK, sometimes it was off to the side, sometimes it was not aimed at the mouth, sometimes it was too close. THAT is the perfect situation for an omnidirectional mic (like the 635) Using a unidirectional mic in that same situation may not have given you the audio you desired. ALSO .. the 635 is a dynamic mic .. there is NO active electronics inside the mic .. therefore it cannot create any hiss Any hiss is coming from whatever the mic is connected to. A Rode Video Mic that attaches to the cold shoe and inputs dual channel audio (I don't know if it is really stereo or not, probably not). That's a mono mic .. the stereo version looks different and is called the Rode Stereo Video Mic (and also costs more) (snip) I'm sure you audiophiles are aghast that I used a RatShack microphone instead of some $200 thing but it works for me with what I'm doing. I'm happy with it. Very often an inexpensive mic placed close to the subject will outperform a much more expensive mic placed far away. Of course the expensive mic placed close will likely be better still ;-) I made a home made Mic flag for it that came out pretty well. So between the MIc flag, the Rode Mic and the tripod I think I made quite the impression. I had a few people ask me what TV station I was recording for! You can purchase blank mic flags that come with foam inserts. A bit of photoshop or even a word processor .. some sissors .. and some rubber cement and you have a mic flag that (on camera at least) is hard to tell that it wasn't custom made. - Original Message - From: pageflex2001 I have two of the Electro Voice 635a mics and they are very lasting. Now my question is; Isn't the RE50B omnidirectional - meaning it will not isolate the unwanted background street noise. Yes it is omnidirectional ... but so is the 635a. Just because it is omnidirectional does not mean it will capture all the unwanted background street noise. Sensitivity is also an issue. When your mouth is a few inches away from the mic it and the background noise is both much lower in volume and much farther away .. you will hear mostly your voice. Remember, the RE50 is can be seen daily on TV someplace in the country being used by on-the-street newscasters. If it wasn't good TV newcasters wouldn't be using it. Also what's the difference between the RE50B and the RE50N/D-B. The Electrovoice site says that the RE50N/D-B adds high-output Neodymium capsule magnet. What does that do? It gives the mic a higher output (more signal) I'm curious what benefits brings upgrading from my 635a to RE50N/D-B. Well, since the RE50 is nothing but a 635 inside .. you get a more professional looking housing that reduces handling noise more than you have now ... you get the Neodymium magnet for higher output (but you *can* get the 635 with the same option if you want) Richard Amirault N1JDU http://bostonfandom.org

I have a Panasonic TM300 which is a nice small camera but has a traditional 1/4 microphone jack. I know there are XLR converters which would be fine but all the ones I have seen are super huge and bulky, which kind of defeats the purpose of the small camera. So can anyone suggest a decent microphone with the right connector or a small XLR converter? Thanks. I *seriously* doubt your camcorder has a 1/4 mic jack ... most likely it's a 1/8 jack. How about something like this for an adaptor.. http://www.bhphotovideo.com/c/product/158476-REG/Hosa_Technology_XVM_101F_Mini_Stereo_Male_to.html (search for Hosa XVM 101F at bhphotovideo.com if link is broken) You'd need to add a regular XLR mic cable to reach from your subject to the camera and you'd need to use a dynamic mic or a condensor mic with a built-in battery since you won't have phantom power with this setup. - Original Message - From: Jay dedman It recently occurred to me that the advent of Touch Screen technology is the reason Apple rebuilt iMovie a couple of years ago. The new format is perfect for touch screen editing. If it works, expect more NLEs to experiment with this stuff in the next few years, especially if iMacs start to go Touch Screen. I would LOVE to edit with a touch screen. just seems like it'd be more fun and direct. Re: [videoblogging] new to the group - question about filming
- Original Message - From: loretabirkus 1. I was asked to film a short 1-2 min clip for one small company. The president does workshops for his clients and I'd like to get some shots of that. However, I checked out the room where he's doing the workshops and it's pretty dark, ceiling florescent lighting, dark sand color walls and kind or cramped. I figured out the angle from which I will film, but I'm afraid there won't be enough lighting. I do have lights that I use for studio type picture taking (2 of them) and I will bring those, but in order to get use of them, they'd have to be upclose to people I guess. However, then the lamps would be seen in the picture. How do you usually resolve the issue of lighting in small, having no windows rooms? I was thinking about increasing the exposure as well if I see that there's still not enough lighting with my both lamps that I have. But any other ideas would be helpful. Assuming that the ceiling is some sort of white ... shut OFF the florescent lights and use your lights but aim them up at the ceiling. They can be off to the side, out of the camera shot. Hoping that your lights are reasonably powered. Try it and see. If your light are not powerful enough than you'll have to aim them directly at the subjects .. but in either case shut off the fluorescents as mixing different colored lights is not a good idea. I remember the first Vloggercon in NYC in 2005 and the second in SF in 2006. My book is a nice how to guide for people starting out in online video. For some of us who have been putting video on blogs wince 2004, it's seems so easy now. When we started there was no YouTube, we were worried that our videos would get popular, because that would cost us money. Now we've got a myriad of free hosting solutions for have lots of great features. But there still are and will always be people starting out. That's where my book comes in. In the book I talk about choosing a camera, getting good sound and lighting, and how to conduct interviews. Also, how to edit and post, and how to go live. I've interviewed a number of Yahoo! videoblogging group members. I made a post today called, Where To Buy Get Seen. It's a very simple post showing where people can order the book. As far as loudness is concerned ... most every editing programs have a way to increase the level of the audio track. Some even have extras built-in like audio filters, and compressors. You could also use dual system sound by recording the audio on a seperate digital recorder (and using a lav mic on your subject, or a hand held mic) and using *that* audio for your finished product. Re: [videoblogging] Open Video Ideas
(I posted this on the blog too). Great Video Michael, I've been teaching this digital media class the last three semesters, and technology is a huge barrier to creativity. First, we only have PCs, so we can't go with FCP, so we go with Premiere Pro, which is functionally find, but has all sorts of issues dealing with different types of files/codecs. I had to teach stuff like, if you have an .mp4 file, you must first convert it to .mov with quicktime, and sometimes the audio won't import so you have to export separately - etc. This doesn't even cover the always pragmatic issue of compression, disc space, and problems with the university's secure network and new adobe programs not working etc. It's so frustrating, and it would be so cool if there was one video engine as you describe, because, at least there would, hypothetically, only be one set of issues to deal with. I look forward to continuing this conversation. ...peace...richard p.s. If I want to subscribe to all Verdi videos, how would I do that? As much as I love my Mac, Apple is frustratingly slow to add specific functionality that I would find useful. And often when a 3rd party jumps in with a solution it's often Mac only (so much for collaboration). Heath, It was both the supreme court and the FCC. First, the supreme court ruled, as you said, that cable was not a communication network, so not covered by common carriage, so they could have a monopoly on their lines. Then later the FCC ruled the same for DSL, ironically, to increase competition. The idea being that if the cable companies could be monopolies, so could the DSL companies, so we'd have a duopoly. Re: [videoblogging] question: laptop for video editing
- Original Message - From: Rupert The more important question is what program you want to use for editing. If you need Final Cut Pro and can spend $1300 on it, you need to get a Mac. If you just need basic editing or even medium- featured editing, it doesn't really matter whether you have Mac or PC - you can use Sony Vegas on a PC ($50) and iMovie on a Mac (free). (snip) I've been using Macs for video for 10 years, and I prefer the interface. But I've also use PCs a lot for work, and have done some video using Vegas, and it's pretty good too - better in some ways than iMovie, but not as good as the much more expensive Final Cut Pro if you want to do lots of fancy stuff. So it's all about what you're going to use it for and what you're comfortable with. You are comparing apples to oranges. First, like Final Cut, there are multiple versions of Sony's Vegas. The consumer version is Sony Vegas Movie Studio .. but even that comes in, I believe, three different versions. Then you have the professional version called Sony Vegas Pro. THAT program lists for $550.00 US. Vegas Pro can stand toe to toe with Final Cut Pro anyday. Yes, there are things that one can do and the other can't .. but it works both ways. - Original Message - From: miglsd27 Thank you all for your replys. What I was looking for was something like what I have in our Vinten tripod, a ball based head, that levels the head only. Adjusting the tripod legs always leaves me sideways when I pan, I hate that. But I see there aren´t many options, altough Manfrotto does seem the best option. For me, an horizon that is not horizontal on the frame (does this make sense?) is more disturbing than a squeeky or bouny pan or tilt movement. But maybe thats just me ;). === It won't be sideways when you pan if the tripod is level (that was the point of adjusting one of the legs) A suggestion: see if you can find a circular level. Some tripods have this built in, but you can buy a general purpose one that is somewhat bigger than a built-in one .. but will work for setting up the tripod. It's a round device with two or three concentric rings and, of course, a small bubble of air inside. It helps to level in two dimensions ... more like 360 degrees. - Original Message - From: RatbagMedia (snip) But there's one thing that strikes me vis a vis video podcasting/blogging and audio podcasting/blogging: editing video is so much easier to do (and do well) than editing audio because there's these easy to follow visual markers. I find it a bit amazing actually: video editing is a breeze compared to all the reviewing you have to do with audio tracts alone. Video is another language of course and you need less in the way of orchestrated inputs to 'set the scene' or advance the narrative. (snip) I think you are making a mistake here. Audio is *still* important. Just because it's the soundtrack on a video does not make is less important. The soundtrack on a video is a *major* part of that video. You still should be talking into a microphone rather than using the mic built into your camcorder. It really makes a difference in the end product.
