usually i stay out of these talks these days but this one...


Most can not be broadcast on community TV because they 
continually use copyrighted content (music) in their productions. 
That is bad teaching, not a bad law 
I don't know about that. Have you ever taught a video
class? Teaching the medium to either filmmakers or musicians
becomes prohibitive without mixing up existing materials.
I suffer the same problems as Adrian (plus I teach video classes regularly)... 
-but in terms of working creatively I've never found it prohibitive,
... sampling of other material is one method, but not using it doesn't
= prohibition of creative ideas. 
On my vlog i've still managed to never use copyrighted music, never
used copyrighted images ( and aside from Creative Commons material in
my revlog), never used video material that i didn't record.

Not to be a licensing weenie, but as I understand it, copyright still 
applies to things, it's just a matter of the usage rights and licensing, 
correct? I mean, I maintain the copyright on the work I create, even 
though I make it available under a CC by-nc-sa license. This just gives 
others the rights to use my work as I've specified. The opposite of 
copyright would be public domain, where you release a work and do not 
claim any sort of copyright to it. (If I'm wrong on any of this, please 
correct me.)

capturing "the history of our day?" Aren't sexual issues part of that 
history?
It is really outrageous that they took your vlog 
off. And, I say that, as someone who doesn't fully agree with your 
viewpoint. 

Actually, I watched this vlog and I felt it treated 
men unfairly. It made me mad. That is good. Something that 
provokes you and challenges you to think is good whether you like it or 
not.

infringement on their Barbie mark and the counterclaim by MCA for
defmation...in the US 9th Circuit...in the opinion of the court, Judge

Well, the way I understand Our Media works, it's volunteer moderators 
who flag potential copyright-suspicious vids for later attorney review. 
In other words, let's find out why the vid was pulled directly from 
some moderator's mouth, and furthermore, invite an attorney to address 
this.

Don't know how Archive.org handles such things. Anyone?

Hell, I'd chip in $10 or $20 to hear an attorney's response in a 
videoconference. If 20 vidconference participants anti up that ought to 
cover an hour of the hapless attorney's time.

not sure the tone of that, but no, it makes them professional :-)

you always indicate (must indicate) licencing information in the 
credits, if you don't have a licence to use it, then you can't. There 
is an enormous amount of good video made in my home city (Melbourne) 
in schools. Most can not be broadcast on community TV because they 
continually use copyrighted content (music) in their productions. 
That is bad teaching, not a bad law (copyright law is stuffed, but 
the principle is fine).

not sure the tone of that, but no, it makes them professional :-)

you always indicate (must indicate) licencing information in the 
credits, if you don't have a licence to use it, then you can't.
ourmedia has a great system for taggin used / 'remixed' media
 There 
is an enormous amount of good video made in my home city (Melbourne) 
in schools. Most can not be broadcast on community TV because they 
continually use copyrighted content (music) in their productions. 
That is bad teaching, not a bad law 
I don't know about that. Have you ever taught a video
class? Teaching the medium to either filmmakers or musicians
becomes prohibitive without mixing up existing materials.

The Kuleshov Workshop basically created modern montage by re-using D.W. Griffith's footage.
(copyright law is stuffed, but 
the principle is fine).
The principle is great, within a medium. Once you leave the
source medium, realistically it is more like a 'cover' within the same
medium, and limiting its use in the same manner causes many
problems. Not the least of which, I can attest, is to classes at
Universities.
