is a copy at the Library of Congress they could view and that  is a pretty

I have a faculty member who is positive he once watched a production of José 
Rodríguez Méndez's "Teresa de Ávila" on VHS at Centro de Documentación Teatral 
in Spain. Unfortunately, searching their catalog today for this item returns 
zero results and he is anxious to find another copy to use in class. I've come 
up empty handed, perhaps someone on this list will have better luck finding it?

I have a doozy of a request.

I have a scholar from Russia who is trying to track down permission to reuse 
images from the film "The Million Eyes of Sumuru," (1967).

He is also interested to find archival resources as well.

I've checked the imdb.com database, but I was unable to find a link to the 
original production company.

Worldcat lists UCLA Film & Television Archives as owning a film print.  
However, when I visited the UCLAF website and searched their catalog, this 
title did not appear.

Any help is greatly appreciated about where a person might find the rights to 
reuse images from this film, as well as which archive, if any, has film 
memorabilia, etc.

Wow you sure come up with obscure ones.

I am not clear what the scholar wants the images for but if it for
something in the US it would almost surely be covered by "fair use" since
he only wants images. One problem might be that if he needs them for a book
or similar publishers often require clearance  even if it is not legally
needed but then again use outside the US is not so clear.


There is a good chance the film does not even have a valid US copyright
however since it was not made in the US,  a retroactive copyright could
theoretically be filed.

There appear to be some copies of questionable origin floating around the
internet.

I had the same thoughts as Jessica about claiming fair use for the images,
but also--like Jessica--wondered if the international nature of the
scholarship, or publisher requirements, were driving his search for
permissions.

Anyhow, I think I may have some useful information for your scholar.  I
noticed this film was used in an episode of MST3K, leading me to wonder if
it might be public domain.  Alas, the film's copyright was renewed in 1995:

Hi Monique,

When I published The Queer Movie Poster Book back in 2005 with Chronicle Books 
I definitely relied on Fair Use. In cases of small distribs where I had easy 
contacts I went ahead and requested permission letting them know I had no money 
to pay. When I asked Fine Line if I could use the Hedwig poster they said their 
standard charge was $1,000 for use and I explained that unless they could waive 
the fee I would simply have to eliminate the film from the book (thankfully 
they went ahead and waived the fee). 

FYI — I do also own a pretty nice 16mm IB Tech print of The Million Eyes of 
Sumuru (tho I do not have any rights, just the print). It is an amazing film.

Hello Monique,
I had the same thoughts as Jessica about claiming fair use for the images, but 
also--like Jessica--wondered if the international nature of the scholarship, or 
publisher requirements, were driving his search for permissions.

Anyhow, I think I may have some useful information for your scholar.  I noticed 
this film was used in an episode of MST3K, leading me to wonder if it might be 
public domain.  Alas, the film's copyright was renewed in 1995:

director of the company is Veronique Beatrix Van Broekhoven.  The researcher 
can contact her via snail mail at 2 Castle Gate Mill, Cragg Vale, Hebden 
Bridge, West Yorkshire, HX7 5SJ in the UK.  Towers' widow--Austrian 
actress/Jesus Franco regular Maria Rohm--has a website and may be able to

I am not clear what the scholar wants the images for but if it for something in 
the US it would almost surely be covered by "fair use" since he only wants 
images. One problem might be that if he needs them for a book or similar 
publishers often require clearance  even if it is not legally needed but then 
again use outside the US is not so clear.

There is a good chance the film does not even have a valid US copyright however 
since it was not made in the US,  a retroactive copyright could theoretically 
be filed.
There appear to be some copies of questionable origin floating around the 
internet.

No luck finding an available copy to purchase.
Tried Worldcat and the distributors - looks like the production company is 
Argentina : Grupo Cine Liberación, which is leading me nowhere and Solanas 
Productions, also nowhere.
I also found Cinesur - but it is in Spanish, and I'm not fluent enough to 
figure it out.

I snatched up a used Cinesur copy on amazon last year and I'm pretty sure it 
was the only one available.

I do see it on ebay and from the picture it looks like it's a legit copy:

Yes, it is strange, but I looked at our acquisitions order record and the copy 
I bought on amazon was something like $8.99. At the time I was skeptical, but I 
spoke with one of our colleagues at a another university who had a legit copy 
just to compare them and make sure it wasn't a bootleg.

Um that is the Korean bootleg. I know it can often be hard to tell but I
think you can pretty much bet the farm they do not have a contract with the
rights holder let alone one that allows them to sell copies in the US.

 selling nothing but bootlegs, this is the largest seller of DVDs.

 would usually have format, titling and packaging points that would
 distinguish them

[Videolib] Looking for Film: Gettin' Back

One of our faculty members is trying to find a copy of a 1974 film called 
Gettin' Back



It's a documentary about the May 1973 Ozark Mountain Folkfair in Eureka 
Springs, AR



This site has a little bit about the festival

It included performances by a lot of well known artists including Earl Scruggs, 
CJ Chernier, Big Mama Thornton, and Leo Kottke (the reason we're looking for 
it). According to the NYTimes and BFI film databases, it was directed by Gary 
Crabtree and produced by Ronald McCulloch. The production companies are listed 
as McCulloch Enterprises and Crabtree Films.



There is no entry in OCLC for it... and I haven't found any of it on youtube, 
which I sort of would have expected...



I've found a Linked In listing for Gary Crabtree, but I've also found a mention 
elsewhere from just a couple of years ago that he does not own a copy... so 
contacting him is probably a last resort for the faculty member.

I'm hoping that some library/archive that has a collection of materials on 
country rock / roots music might have a copy of the documentary stashed 
somewhere uncataloged... anyone?anyone?

Hi Marc,

We recently purchased this film, and the only copy we could find was the Korean 
version.  I took a close look at it when it arrived to make sure it wasn't 
dubbed in Korean or anything, and found it to be an acceptable copy.  The menu 
and case may confuse some patrons, but anyone who needs to watch the film for 
their research or screen it in a class will be fine with it.  (We were simply 
seeking the film for the collection, so I don't have any input on how you would 
procure public performance rights.)

In 1964, a mob of Klansmen murdered three civil rights workers in the small 
Mississippi county of Neshoba (a crime that came to be known as the 
Mississippi Burning murders).  These young men, two Jews from New York and an

African-American voters during what became known as Freedom Summer.  Although 
the Klansmen bragged about what they did, no one was held accountable for 
murder until 2005, when the State indicted the mastermind of the killings,

It is, indeed, a very interesting question since different vendors count views 
or engagement differently. I was recently looking closely at views/engagement 
for some streams from different vendors for a course and comparing vendor data 
with data from Ares. The Ares data shows user id by date/time. When you look at 
this level of granularity you see multiple hits by the same user within very 
short periods of time, sometimes 10 hits or more in a minute. Clearly they are 
not watching a full film in that short space of time nor are they gaining a 
meaningful browse or “engagement”.  This type of data must be taken with a 
grain of salt. Someone should be able to devise an algorithm based on data 
(patron behavior, hit length, and computer issues) that could be applied to the 
hit data to provide a more realistic picture of what patrons are actually 
watching.

Engagement, depending on how it is defined by the vendor, is probably a better 
measure but still requires some framing. For me, engagement would have to be at 
least 15% or more of the total run time. Certainly not a hit of 30 seconds or 
less, even a couple of minutes for a two hour films is questionable. And, if, 
over time, a film never shows that it is watched in its entirety, should we be 
paying full price or purchasing access to the desired clip? Or, dare I say it?, 
claiming fair use instead.

We need to ask vendors pointed questions about the data they are supplying us. 
Vendors need to be very transparent about that data collection and presentation 
process in order to avoid being labeled as the fox guarding the henhouse .

What data are you counting? Hits to a url or some percentage of the total film 
length a user spent with a film (engagement)?
If its number of minutes watched, what percentage of the total films did those 
minute comprise?
How do you define engagement?
How many different users engaged?
What was the date range of the engagement/hits?
What was the last date of engagement/hits?
Were the hits/engagement all for the same portion of the film (clips vs. 
watching a film)?

Streams are expensive and I am sure we are not the only library to be taking 
budget hits. We need to be sure we are paying for streams our patrons are 
actually watching and not just browsing or pinging on trying to get them to 
load, or some other computer issue that is clouding patron use.

I would advocate for a different model altogether, purchase of streams outright 
for a reasonable price the way we purchased VHS, then DVD. Actual ownership of 
the format until it changes to a new format. Then all this counting could be 
amortized over a much longer period of time, the enormous and expensive 
investment libraries make in purchasing licenses, tracking licenses, and 
renewing licenses could be better spent on other activities. And perhaps we 
would have the time to devise an automated way to track patron viewing behavior 
that would provide us with meaningful and reliable data on which to base 
purchase decisions.

I think Jonathan asks a very interesting question. The different platforms for 
streaming report “engagement” or how long someone viewed the content, with 
varying degrees of granularity. But I know that for us hard copy circulation is 
steadily declining and streaming use is growing every year. Unfortunately our 
hard copy collection also took an accessibility hit a couple of years ago when 
I had to reduce hours in the Film and Media Library, because of a rather 
unexpected staff loss due to a layoff.  So I think the physical collection has 
had several strikes against it. I have hatched a scheme to move the physical 
collection back to the main library for greater accessibility, but that may not 
come to fruition for several years.

Accordingly, I am adding fewer and fewer DVDs and more and more streaming 
titles.

less, even a couple of minutes for a two hour films is questionable. And, if, 
over time, a film never shows that it is watched in its entirety, should we be 
paying full price or purchasing access to the desired clip? Or, dare I say it?, 
claiming fair use instead.

We need to ask vendors pointed questions about the data they are supplying us. 
Vendors need to be very transparent about that data collection and presentation 
process in order to avoid being labeled as the fox guarding the henhouse .

What data are you counting? Hits to a url or some percentage of the total film 
length a user spent with a film (engagement)?
If its number of minutes watched, what percentage of the total films did those 
minute comprise?
How do you define engagement?
How many different users engaged?
What was the date range of the engagement/hits?
What was the last date of engagement/hits?
Were the hits/engagement all for the same portion of the film (clips vs. 
watching a film)?

Streams are expensive and I am sure we are not the only library to be taking 
budget hits. We need to be sure we are paying for streams our patrons are 
actually watching and not just browsing or pinging on trying to get them to 
load, or some other computer issue that is clouding patron use.

I would advocate for a different model altogether, purchase of streams outright 
for a reasonable price the way we purchased VHS, then DVD. Actual ownership of 
the format until it changes to a new format. Then all this counting could be 
amortized over a much longer period of time, the enormous and expensive 
investment libraries make in purchasing licenses, tracking licenses, and 
renewing licenses could be better spent on other activities. And perhaps we 
would have the time to devise an automated way to track patron viewing behavior 
that would provide us with meaningful and reliable data on which to base 
purchase decisions.

unexpected staff loss due to a layoff.  So I think the physical collection has 
had several strikes against it. I have hatched a scheme to move the physical 
collection back to the main library for greater accessibility, but that may not 
come to fruition for several years.

Accordingly, I am adding fewer and fewer DVDs and more and more streaming 
titles.

Very interesting questions.  Just to help clarify.  We have one portal so that 
we can get our statistics from one place.  We also purchase in perpetuity/for 
the life of the film format so we don't have to worry about renewing for the 
most part.  There are a few exceptions.  And we expect to pay a reasonable 
price.

A circulation is a view in this category, though I can slice and dice it by 
minutes of viewing if I want.  But what's to say when someone checks out a 
physical copy, do they watch the whole thing.  We count circulations for 
physical copies when we do an analysis of use, and we don't know how much of 
the film they are watching.  They could start it, stop it for a bit and then 
start it again.  So I was counting circulations, no matter how long just like 
physical copies.  Yes, we have more control over streaming statistics and I can 
break it down by length of time and what percentage of the collection is being 
used.  I may just do that to see (15% or 10 minutes)?

As far as circulation for 2013-2014, we did not have the budget to purchase 
streaming that year so we primarily purchased hard copy that was being 
requested.  That is one factor in seeing the increase in hard copy circulation. 
 This year I was able to purchase in-perpetuity more streaming titles that were 
being requested so I suspect I'll see another jump in streaming.

This is a different medium so it will be interesting to do some further 
statistical analysis.  I'm lucky in that I have one portal so I don't have to 
depend on how different distributors count views.  I can see the length of time 
they are viewing and I can also determine whether they are viewing the whole 
film or just clips.  And I can determine if they are a student, staff or 
faculty member by class.

I am tapped, cannot think of any titles that cover the subject of global health.
She is willing to go outside the box - Blood Diamond is too far outside the 
box, but she is looking for any issue on global health (AIDS, viruses, dirty 
water causes malaria, etc.)
ANY ideas are greatly appreciated.

Contagion is an excellent suggestion.


There's also the classics Omega Man, Andromeda Strain, and Invasion of
the Body Snatchers. Others are Outbreak (which is great fun about a
deadly serious subject, and suspenseful),  Gilliam'sTwelve Monkeys, which
is based on Marker's La Jetee, or to be silly and over the top
Cronenberg's first film Shivers,  that really does drive home the serious
matter of global contagions. There is one more that I just cannot think of;
it was set in contemporary London, and quite realistically shows how social
order quickly erodes in the face of widespread panic over a virus, not
unlike the bubonic plague. I want to say it was an HBO production. I will
certainly send it if I can think of it.

[Videolib] Looking for old film Lay My Burden Down

Good morning,

A graduate student is looking for a copy of the 1965 film by Jack Willis, Lay 
My Burden Down.  It was shown on NET back in the 60's.  So far, I can only find 
four institutions that seem to have a copy.  None has it on VHS although I saw 
a record in World Cat for a vhs copy.  The only other format is 16mm.  
Unfortunately, we no longer have a 16mm projector. And I doubt a library would 
lend their 16mm copy.

Does anyone know if this film is available for ILL in a VHS format?  Any 
information would be greatly appreciated.

I don't think there ever where any VHS copies. That Worldcat listing is
likely a mistake as it shows no copy held but that NYPL ( the listing) does
have 16mm.  Sadly lots of things never made to VHS or any digital format.
It seems to exist only in 16mm. There was a screening of it last year at
Brooklyn Academy of Music. You might try them to see if they found a rights
holder to clear it from , that would be one way to find out.

The 16mm print that was screened at BAM last year came from the Reserve
Film and Video Collection of the New York Public Library.  Permission to
provide the print for the screening came from Jack Willis who owns the
rights.  The student is always welcome to come to New York to view the
print here at the Library for the Performing Arts but we are, even with
permission from Mr. Willis, unable to make a digital or analog video copy.

I kind of figured it came from you Elena. Jean I would suggest you get Mr.
Willis contact info from Elena and ask him if there is any chance VHS or
DVD copy. At least you will be going right to the source and I think this
also confirms that the Worldcat listing that NYPL has a VHS copy was
incorrect.

Dear folks,

Obviously, the best you can do is to borrow a 16mm and a projector or you
can try to get ahold of Jack Willis for permission to master a copy.
However, there's a lot more ways to go about this as well since it's just
for research purposes. This is where it pays to be a member of AMIA.

Since it was an NET production, you might want to try the Paley Center for
Media in NYC, the wonderful and very capable...

system to other healthcare systems in capitalist countries  around the world in 
a neutral way, or as neutrally as possible.

We are familiar with Frontline Sick Around the World and that is close to 
what we are looking for, but the instructor thinks it is too dated.

because from that period I suspect the survival rate is no more than 1 or 2
percent. In any event the place you want to start is the FIAF database
which has info on the collections of all the major archives in the world. I
am lazy and just have my friend at LOC look things up for me. Dennis who is
lurking around probably has access. I am sure other libraries do.

If it by some miracle does exist in an archive then you would have to
contact them. Some will make copies depending on the material they have (
rights are not an issue for a 1913 film) but it would cost a pretty penny.

Deg,
I had a friend check and alas it is not listed in the FIAF datebase which
means no archive is known to have a copy. It is theoretically possible that
a copy could exist in a private collection or hiding in a barn for a film
from 1913 the odds are infinitesimal. Sadly the overall survival rate for
all silent feature films ( and this was a short) is about 14%. The
percentage of that 14% that would available in a format you could easily
access would be a tiny fraction of that.

Look on the bright side, there was no problem with rights if you could find
it.
