I think that that is a very argument that
I am going to make  identify the definition of nuisance 
and convince that having more animals are not necessarily
equivalent of nuisance  especially if they are all indoor kept and well
taken care of.

Unfortunately from a
legal standpoint it is looked at as a public health nuisance when
one has more than the generally accepted amount of animals (which differs from
area to area). It does not make sense to me but considering
fanimals (my own term for animals who are family) are classified as
property it is the way the law looks at them, at least here in Pennsylvania.

with what you are dealing with, so I don't know for
sure, but if I had to guess, I would think they would
give you like 30 days to find homes for however many
over the number they allow you. Then, at the end of
30 days, they will probably schedule an appointment to
come by to do a head count. After that, I bet they
don't bother you much and you can bring any kitties
back that kind people have taken in for you for a
short time so that you can pass the head count. I
hope you have family or good friends nearby that will
help you if it comes to that. Plus, in the future,
you don't have to answer the door to anyone from
animal control if you think they are coming to do a
head count again. I doubt they will hassle you
though. I wouldn't worry about all this just yet
though Hideyo, because you will worry yourself sick. 
And if they end up allowing you to have your cats,
then you will have worried for no reason. How in the
world did this all happen in the first place? Did
someone complain about your cats?

oh, sweetie--

I know this has got to be awful for you. Are you able to move? Could you put half your guys at your boyfriend's house?

I know we have a limit here where I live, but because so many of my cats look alike (to animal control officers) and so many run and hide when someone comes over.. they would never know how many I actually have unless my vet ratted me out

pretty funny Tonya---reminds me of last winter when our building made it 
mandatory for us to have their contractor come and check all our radiators. I 
knew the radiatorin the cats' bedroom had a problem but I'd already put 
off fixing it thru one winter for fear news of my 6furryroommates 
would leak out. 
By the 
time the year rolled around and I'd cottoned on to what "feral" really meant 
Ifigured I had little to fear. And sure enough, 
the guy came, checked and fixed the radiator without seeing so much as a whisker 
(I'd hidden all the cat trees etc so it just looked like a room waiting to be 
furnished.)
All 
the furballsscooted into the closet as soon as they heard the dcoorbell 
and didn'temerge till he'd gone. Smart!.

one cat, I had three burly moving men who just moved thru the apt quickly and
quietly. I thought cat had gone into the closet to hide but all of a
sudden the biggest of the moving men came running over to me pleading to get

Hi Hideyo,

I am sorry to hear about your city ordinance troubles.
 I agree with Kerry that having someone else there as
an advocate for the care you are providing is a smart
idea.  Also, be prepared to disprove with proof the
very reasons they are having you in for a hearing in
the first place (ie. unsanitary conditions,
neighborhood disturbance, whatever their reasons may
be).  Be well prepared, even overly prepared.  This is
the very reason I hope to one day have some land out
in the country.  The city government won't be able to
tell me what to do with my life or my furballs.  I
will also say prayers for Ginger to begin eating
better again.  I am sorry for your troubles and I hope
that things start looking up again.  In the meantime,
don't let them get you down.  Keep going strong.

Thank you, I have a letter from my ex-vet who used to care for all my
cats for the past 10 years and she is actually overseeing now the vet
section at the animal control division, which I hope to build
creditability as the letter says how responsible and caring I am for all
my animals.

Different officers came to inspect my place a few times and they were
all very impressed with the set up (I spent $45,000 a couple of years
ago and built facility for my cats in addition to my main house -
windows everywhere, sky lights, outside enclosures.. etc.. and happy how
well all my animals are taken care of.. but yes I will prepare for any
possible ways for them to complain.

I am also going to ask someone I know through rescuing.. she is with
Animal protection service of my state and she has a lot of credibility
with animal control.. so.. we will see.. I am still very nervous because
they CAN take them away from me..

There is a case in PA, where the city gave a lady a citation for having
like 25 to 35 cats and she actually appealed to the PA state court and
actually the state court ruled against the city's ruling saying that,
having numerous number of cats itself merely do not prove the presence
of nuisance, - should I bring a stuff like that??? What other factual
information should I bring??

people on your side. You will be using them right? Wow againyour
facility---can you take photos of your facility and receipts for the
work to the hearing to show how much work you're done to prove you are

I know how worried you must be, but I can't think of anything else you
could do---you've taken care of everything. Just make sure THEY know it.

Thank you, I have a letter from my ex-vet who used to care for all my
cats for the past 10 years and she is actually overseeing now the vet
section at the animal control division, which I hope to build
creditability as the letter says how responsible and caring I am for all
my animals.

Different officers came to inspect my place a few times and they were
all very impressed with the set up (I spent $45,000 a couple of years
ago and built facility for my cats in addition to my main house -
windows everywhere, sky lights, outside enclosures.. etc.. and happy how
well all my animals are taken care of.. but yes I will prepare for any
possible ways for them to complain.

I am also going to ask someone I know through rescuing.. she is with
Animal protection service of my state and she has a lot of credibility
with animal control.. so.. we will see.. I am still very nervous because
they CAN take them away from me..

I am sorry to hear about your city ordinance troubles.
 I agree with Kerry that having someone else there as
an advocate for the care you are providing is a smart
idea.  Also, be prepared to disprove with proof the
very reasons they are having you in for a hearing in
the first place (ie. unsanitary conditions,
neighborhood disturbance, whatever their reasons may
be).  Be well prepared, even overly prepared.  This is
the very reason I hope to one day have some land out
in the country.  The city government won't be able to
tell me what to do with my life or my furballs.  I
will also say prayers for Ginger to begin eating
better again.  I am sorry for your troubles and I hope
that things start looking up again.  In the meantime,
don't let them get you down.  Keep going strong.

Ah, yes, good idea. Very good idea. Pix of building, indoors and out,
plus cats shown in the building, plus closeups of cats to show how well
they are. Plus receipts of all the meds you buy including homeopathic.
Hideyo, no one cares for cats better than you---I hope some of those
people sitting in judgment have a cat or two---you can be sure they
will be secretly thinking, wow, this woman takes far, far better care
of/spends far more $$ on her cats than I do. But they'll never tell you
that.

The suggestions given sound good, being prepared with pictures of your
habitat, receipts for medical and housing costs etc. Could you write
up some sort of acknowledgment of your general good deeds in caring for
the cats? Get as many signatures on it as possible, vets, neighbors,
etc. How much time do you have before the hearing? I know the folks
on this list would be willing to sign too, if we can figure out how to
do that logistically. I know from stories you've posted on the list
that you've run across some influential people while doing rescue work,
government officials, media people, get their signatures and short
statements about who you are and what you do too. Some sound legal
advice is in order as well, here's the link to ALDF, (Animal Legal
Defense Fund). Write or call them and tell them what's going on and
ask how they can help. They have attorneys that do pro bono work for
good folks like you.

Thats a good idea  I am not
a good writer but I have an idea, and Greg is a lawyer and writes really
well.. so maybe he can edit it  I have 5 days to request a hearing from
this Wednesdays thats when an office will bring me all the paper work I
need to request a hearing, but I am not sure how long before the hearing.. I
will write to ALDF to see if they have any suggestions.

rather, that they give you ample time to place them in
other homes.  But if it was me, and I hope I don't
offend anyone by saying this, if they told me I had to
get rid of some of my animals, I would say ok, and
take them to my moms until they came back to check,
and then like a teenager, I would bring them right
back home.  I've always been a little rebellious like
that.

a home for them.. which I won't --whenever I look a home for them, I end

I have never heard of anyone I know personally dealing
with what you are dealing with, so I don't know for
sure, but if I had to guess, I would think they would
give you like 30 days to find homes for however many
over the number they allow you.  Then, at the end of
30 days, they will probably schedule an appointment to
come by to do a head count.  After that, I bet they
don't bother you much and you can bring any kitties
back that kind people have taken in for you for a
short time so that you can pass the head count.  I
hope you have family or good friends nearby that will
help you if it comes to that.  Plus, in the future,
you don't have to answer the door to anyone from
animal control if you think they are coming to do a
head count again.  I doubt they will hassle you
though.  I wouldn't worry about all this just yet
though Hideyo, because you will worry yourself sick. 
And if they end up allowing you to have your cats,
then you will have worried for no reason.  How in the
world did this all happen in the first place?  Did
someone complain about your cats?

Hideyo,you will be in my prayers every night. I don't know what I would do if someone tried to take my fur balls. I do believe it would kill me. I hate to think of the anguish you must be going through. We all will keep positive thoughts and with Gods help everything will turn out fine.

I don't remember - I think I just went in and described what I wanted. Comes in different size rolls and it may have been with the roll-up bamboo -type shades or close by. That is what I got at the same time. It has been over a year -- the city code people cited my carport for having things on it that weren't designed to go outdoors - like a couple of bookcases. I was lucky that they didn't walk the whole carport and look in the den windows - and see WAY over the allowed limit of cats. that to just passively answer questions as they come.  Definately get your
previous vet's support - in writing - and contact ALDF and maybe even Best
Friends Sanctuary - they've been known to help out too.

Man, I feel for you Hideyo.  Some people just don't
have a life and they get into everyone else's business
and cause problems because they don't.  I hate that.

 sure, but if I had to guess, I would think they

 give you like 30 days to find homes for however many
 over the number they allow you.  Then, at the end of
 30 days, they will probably schedule an appointment

 don't bother you much and you can bring any kitties
 back that kind people have taken in for you for a
 short time so that you can pass the head count.  I
 hope you have family or good friends nearby that

 help you if it comes to that.  Plus, in the future,

 animal control if you think they are coming to do a
 head count again.  I doubt they will hassle you
 though.  I wouldn't worry about all this just yet
 though Hideyo, because you will worry yourself sick.

Athena and Artemis are about 6 months now - but they are still kittens.
My vet is on temporary leave (pregnancy) during November, but I hope to
have her spay the girls - probably just after Xmas since I have the week
between Xmas/NewYears off from work.  I really need to get new pics...

Legal Defense Fund in CA (they have a website with contact info) and ask for a 
referral to a pro bono attorney in HI to help you at your hearing.

If you have a place to foster any of your kitties 
temporarily, you might want to do that ASAP. When do you go to 
court? Depends on how crappy the law feels that day ... I do know of a man 
in the northeast a year or two ago, the law came in without warning and took 
everyone of his personal and rescue kitties. By the time he had a lawyer 
to try to get his kitties back, most had been euthed. Yes, horror story, 
which is why it has stayed with me a long time. I was not there nor know 
him personally. From what he said and having read his posts (different 
list) he seemed like a genuine animal caring person. I realize this will 
intensify your worry andsleeplessness, I am so sorry, but you do have to 
do whatever you can to save your babies. The real wrath of it is people 
like us who have over the city limit of animals but are devoted caretakers get 
in trouble but people who have even only one pet, neglected and abused, do not 
get caught and the animal suffers. It really makes me angry. 
Prayers and hugs for you and your babies to be safe. Wish I could do 
something more for you.

  actually overseeing now the vet section at the animal control 
  division, which I hope to build creditability as the letter 
  says how responsible and caring I am for all my 
  animals.  Different officers came to inspect my place a 
  few times and they were all very impressed with the set up (I 
  spent $45,000 a couple of years ago and built facility for my 
  cats in addition to my main house - windows everywhere, sky 
  lights, outside enclosures.. etc.. and happy how well all my 
  animals are taken care of.. but yes I will prepare for any 
  possible ways for them to complain.  I am also going to ask 
  someone I know through rescuing.. she is with Animal 
  protection service of my state and she has a lot of 
  credibility with animal control.. so.. we will see.. I am 
  still very nervous because they CAN take them away from

Hi Hideyo,
I have been reading that you were having a problem with the animal control...I do understand..
Today in our local paper...it stated we were to only have no more than 3 dogs and 3 cats on our property in the city limits...So believe me I know what you feel...I wish they would understand that we give quality care to our animals and they are part of our family or in my case they are my family...
I am behind you 100% as I know the entire group is...
