Well tom,

to a great extent it seems very capricious indeed. There was for instance 
one metroid remake which got not just shut down, but actually got the 
creator's ip banned from his server without any warning, yet there is 
another far more high profile project sitl continuing un malested, with lots 
of news and reports everywhere!


Ditto for other games. One remake of boulderdash,  Dx boulderdash, had 
to be renamed dx diggem because first star software, who both own the 
original game and are stil! releasing bd games today for mobile phone and 
gba.


Yet a small scale independent developing company (much like  a lot of audio 
game devs), have released three commercially sold games under the title 
"boudlerdash, dig the past"


It virtually seems a lottery to me,  which is all the more reason what 
happened to monti was so completely mad!


If however it's a lottery, - why not play? You've got to be in it to win 
it afterall.


that's to say, freeware remakes,  knock yourselves out!

Btw, one notion I have had is a turrican remake in audio complete with the 
award winning music,  though i will admit that sinse Turrican remakes 
have been endorced by the games' creator, and indeed the original games are 
available under a "not for profit" type agreement if you have the emulator, 
this is a mildly different situation for that game at least.

Well, as has been said many many times already it is all up to the
copyright holder how they want to handle it. Some don't care about
remakes and some do. I've seen several freeware classic remakes for
Linux such as Packman, Asteroids, Bomberman, Super Breakout, and

of the games Activision probably doesn't consider those games

clones floating around the net.
However, as you said Nintendo is another story. They have consistantly
squashed remakes, and actively protect their best sellers like
Megaman, Castlevania, Mario, and others. So it is a good idea to stay
away from Nintendo's copyrights  for that reason.
However, this only proves the point though that some companies are
more relaxed than others. You never really know how a company will
respond to your project until it is out there, and they know it is
there. some will ignore it, and others may take some sort of legal
action. Who knows?

Hi Will,
Like Phil and I said you can, but you have to be careful in how you do
it. If you want to create a classic remake of Castlevania don't call
it Castlevania call it something else. Avoid using names, characters,
music, and sounds from a copyrighted work. Game concepts are fine as
long as you are willing to add some new and unique content to it.
Shades of Doom was enspired by Doom, but is not close enough to the
original work that David Greenwood has to worry about copyright
issues. Instead of enemy soldiers and demons Shades of Doom uses
mutant humans, rats, cyborgs, and a new back story for the game. He
basically used the Doom idea to create his own game which is similar,
but the important stuff in the game is different enough to be
perfectly legal.
Back when James North was running ESP he took two classic games
likePackman and Space Invaders and came up with a couple of truly
unique arcade games such as DynaMan and Aliens in the Outback. Both
were borrowed from the classic arcade genre, but with a little
creativity he came up with something new and unique. That's what we as
a community have to do as well.

private use, then there isn't much they can say or do about it.
