Here's the situation. I removed the 2.6.39 kernel and then restarted. The GRUB
was loaded and the kernel was still visible. I selected it and then I got a

I'm afraid there is no 2.6.38-9 kernel visible on GRUB. Only the

That is the standard kernel. I think the patched kernel is called
