I think what he saying that its not a regulation issue.  Building a 
project without an Engineers design puts you the constructor 100% liable 
for any damages, etc.  The insurance company will immediately claim that 
you did not follow proper engineering standards in the state of 
construction, and therefore you will not be covered.  

Almost all states require a PE stamp on any engineering drawings for 
construction.  Those construction systems that don't have them are "self 
insured" by nature.  As an PE in two states, I know this....   Thats why 
a PE is both valuable and dangerous.
