I think you are being too liberal on that interpretation.  Not many AHJs 
accused of that - lol.  Back to point, the number of stories for type 
construction etc is measured from the horizontal separation but the building 
height (which limits the use of 13R) is measured to grade (510.2.6 - 2015 ed).
