Marek is right here that TB! behaviour as decoding HTML is proper. As far as I remember you can have parts of the page in one coding and the other part in other coding. Enforcing the coding from Header would mess up such messages - my second thought. At that point I was wrong and TB!'s approach to use coding from HTML body looks like to be proper.
