NELs are predetermined at the start of the race. The producers of the show have made that clear in interviews before.
However, they have changed NELs to double legs before due to logistics. If memory serves, they once made a NEL a double length leg because begging (the previous penalty for being last in a NEL was taking all their money) was illegal in the country they would have been eliminated in. They later did away with that penalty when it became clear that it's wrong to have first worlders begging for cash amongst the backdrop of actual poverty in some of these countries.
