Let's see... Apple, Microsoft, Commodore, Digital Research, Quarterdeck, and no doubt a dozen others were doing the same. Remember, back in the early 80s the whole idea of patenting software and computer user interfaces was treated with derision if it was thought of at all. Source code was clearly protected under copyright, but nobody expected the current morass... And software patents have been uniformly disasterous for the industry.
