Let's see... Apple, Microsoft, Commodore, Digital Research, Quarterdeck,
and no doubt a dozen others were doing the same. Remember, back in the early
80s the whole idea of patenting software and computer user interfaces was
treated with derision if it was thought of at all. Source code was clearly
protected under copyright, but nobody expected the current morass...

And software patents have been uniformly disasterous for the industry. I have
yet to find a single example where a patent or a sustained interface copyright
has benefited anyone except so far as it's protected them from being sued
by someone else who holds a related patent... which is hardly an advantage.

Yes, that was stupid. I'm not saying Apple hasn't done some stupid things,
but...

Speaking as one of the people who helped develop the open source
software in question I think Apple's been quite admirable in their
support for FreeBSD and their contued open-sourcing of Darwin
without which none of us would be running OS X at all.

This mailing list is a testament to Apple's surprising openness.

And if you want to protest Apple's behaviour by voting with your feet,
why not support the specific open source project that has been used
by Apple and go with FreeBSD?
