OK, I just tried this on my 4S and you are correct, I am not able to turn
off Voiceover with a triple click home when the phone was to my ear or if I
moved it away and covered the sensor.

However, If you dial a number or double tap on a stored number/favorite and
keepthe the phone away from your ear,
Voiceover and the call are at first on the earpiece and not on the speaker.
You can at that point turn off Voiceover with a triple click home, then put
your phone to yor ear and have the conversation without Voiceover and, since
Voiceover is not running, taking the phone away from your ear will not put
the call on speakerphone.

Lastly, if I take the phone away from my ear and don't want the call to
switch to speakerphone I simply cover the top part of the phone which means
the proximity sensor still thinks the phone is up to my ear and it won't
switch to speakerphone. You can even put your phone on a table face down and
this works.

At least on the iPhone 5, while on a call you can't turn Voiceover off with
a triple press of home while the phone is still to your ear.  You would need
to then move the phone away from your ear, thus putting the device on
speaker phone.  This leaves one with the problem of having their phone stuck
on speaker phone, with no way of turning it off.
