How can you prove an email came from some company? Someone who wants to harm my business can send email from Asia advertising my service and has a link to my website. Can I get sued for this even though I never sent anything?

Legislation, in and of itself, will not change behavior, it takes
enforcement, either criminal (if this is a criminal statue) or civil.

Who will enforce this? Unless funds are budgeted for enforcement, this will
be one of the thousand of "feel good" laws that are completely useless.

California has anit-spam laws on the books, and we are currently going after
a California company for violation of the California specific statue. It has
a liquidated damages clause, which means I do not have to prove damages,
just a violation.

The biggest advantage of the legislative is to drive spammers to send from
outside the US. This way they can be blocked much easier. The legislation
won't stop spammers from sending out spam however. And when countries like
South Korea find out that they are being blocked by the US, they will
initiate their own legislations once they see their businesses are being
hurt because they can't communiate by email with the outside world. Anyway
you see it, it's going to help
