No, the best protection so far is full disclosure and the FTC can
certainly regulate that. Let me give you an example they give, which I
have encountered myself. A medical clinic is stating that it will send
you information on various diseases. It in turns asks you for your name,
address, and insurance carrier. The unsuspecting gladly sends this in
asking for the pamphlet on diets for diabetics. The clinic then sells the
information that John Doe has diabetes to all insurance companies asking
for it. It is then more difficult for that person to get health or life
insurance, and they never knew what hit them. There must be complete
disclosure of what is to be done with information provided so that
informed consent may be given.
It is very easy for the FTC to enforce this. They have a right to
subpoena this information from the clinic and determine what they have
done with it. If their records show it flowing out to a third party after
they have said it would not, prosecution will follow with onerous fines.
If they put in a regulation that you must disclose in a privacy statement
and there is none, they will likewise fine forthwith.
This is a serious matter that those not in the health industry who have
not been sick themselves are oblivious of. Unfortunately, many in the Web
business are young and the young feel they will remain healthy and do not
even need health insurance. In a few years they will feel differently.
Ask one who has battled for adequate insurance coverage as a 15 year colon
cancer survivor.
