I ran into the same issue here. Some Nintendo DSs appear to have the same behavior. I asked Nintendo about it and they had no plans to change the behavior of the Wii. It honestly sounded like they had no idea what I was talking about when I asked about disabling lower data rates. I had to keep the 1 and 2 Mb data rates on our devices ESSID. We have too many Wiis on campus to just ignore them.
