You can, but in the case of the DS at least, that doesn't help. 1 or 2 Mbps must be a basic / mandatory rate for the DS to even see the network. We were hoping that the Wii would be saner in this regard -- I also opened a ticket with Nintendo to inquire. It appears that the DS relies on beacons (which it won't hear since they're at an unsupported rate) and won't send out a probe request that might trigger a response at a supported rate.
