Hello everyone,
To update, thanks for those of you emailed me about the situation at Breezy.
I have learned that the Breezy Point Coop won a court battle over 50 years
ago, and is under the impression that they are one of the few places in the
US where land is owned to the "low tide line" (not the high tide line).
>From what I have read, this is because the decision in the case stated the
Coop owns new land that was created by the construction of a jetty.  This
was supposed to mean new beach that was created, however the Coop has
interpreted the ruling to also include land that is under water.  It seems
like a complicated situation there, and although you might be able to win
in court because of the Public Trust Doctrine and likely incorrect
interpretation of the ruling, it wouldn't be worth the hassle.  If you
really wanted to be a jerk though, you could always walk in the water past
the low tide line!

[nysbirds-l] EPCAL, Calverton 6/11

I visited EPCAL in Calverton in hoping to see the resident blue grosbeak.  
While I struck out with the grosbeak, I had a very pleasant morning at this 
lovely property, viewing grasshopper and field sparrows, good numbers of pine 
and prairie warblers, orchard orioles, flycatchers, and a yellow-billed cuckoo 
who, withstanding the traffic on Grumman Blvd and my phone alarm, remarkably 
continued c-c-c-c-c-c-c-kowlping for almost 3 minutes, all while being 
serenaded by oriole and prairie warbler song.

sparrow, and an eastern kingbird regurgitating a pellet:

Just an FYI about general New York Beach Access, I believe the high water
mark (high tide line) is the demarcation used to separate public and
private beach property.  Meaning if you walk on the wet sand that is
covered by water half of the day, you are OK.  There was even a ruling in
1988 in NY to favor this access that overturned a previous ruling on this
issue in Glen Cove.

[nysbirds-l] WILSON'S Phalarope at Jamaica Bay East Pond

For anyone contemplating an afternoon twitch, the Wilson's Phalarope continues 
on the East Pond, feeding near the raunt and showing well from the overlook. If 
you are not familiar with the naming conventions for areas on the pond, here is

Many of the usuals continue on the pond as well including a high number of 
Black Skimmers for me (27). No sign as yet of the White-faced Ibis.

[nysbirds-l] Correction: WILSON'S Phalarope at Jamaica Bay East Pond

After my earlier post I ran into Dan I. who had what was apparently the same 
bird at the south end at 7am. He got a much closer pic, which Andrew just 
helped me ID as a Wilson's. 
Not sure if it's still around. It had left the overlook while my group was 
still there, and was not at the south end when we visited later on. We left the 
east pond around 9:15am. 
My apologies, and good luck if you go looking for it.

Pleased to see & hear four different grasshopper sparrows this morning
singing atop the landfill grasslands at Croton Point just after dawn, along
with four singing male bobolinks.  Vimeo video of one grasshopper sparrow:

Posts for an interpretive sign that will highlight the importance of this
small grassland for these and other species are now up on the NE side of
the landfill with actual sign installation coming next week.

(This is the second interpretive sign for the landfill, both funded via
much-appreciated chapter collaborative grants from Audubon New York to Saw
Mill River Audubon, with installation via in-kind support from Westchester
County Department of Parks, Recreation, & Conservation.)
