The actual source code is not covered by patents, "only" algorithms

To me this is the same legal minefield as the one surrounding the
Intel IPP based G729/G723.1 implementation floating around out there:

- I don't want to make the distinction between "research" "commercial use" etc.
- Even discussing these "free" implementations on this list could be
viewed as contributory infringement should any of you actually use
these implementations for anything other than "educational use". This
is why Digium (rightly so) removes any links to the IPP sites from the
mailing list. Contrary to popular belief they don't make much (if
anything at all) from G729 licensing. They did it to enable the
Asterisk platform in commercial implementations, not make money
selling licenses.
- Digium is the only entity that I know producing an authorized,
licensed G729 implementation for Asterisk

Digium has not helped us at all with this. Quite frankly their
response on this issue has been very disappointing. As frustrating as
this is we are not helping ourselves by using an unauthorized
implementation (even if that is the only choice Digium is leaving us
with). As ludicrous as it seems to me some of those in management at
Digium may view us as competition to one of their commercial products
(the Asterisk appliance). That may be hurting us too.
What puzzles me is why are the g.729 sound files even included with Astlinux?
Or they certainly were in version 0.4.8
