The data of a corporation is often critical to to the functioning of
that corporation. This no mere laundry or household goods. If a real
disaster occurred and a vendor balked at returning tapes due to a missed
payment period and in doing so did grave damage to the company as the
company potentially could then not recover their business in a timely
fashion, I find it hard to believe the vendor would not be liable to
some degree unless they had stated such policy in the contract. Even
then they may still be liable...

Well, thanks for the effort in any case. This was the wrong place to
present a legal question, all apologies. However if I get the final
word, I'll pass it along... may come in handy for you all down the road.
