I agree. I know that Trek 2000 has floated around for severalyears 
without major public backlash from Paramount. That doesn't mean it 
couldn't have happened, or won't happen. Yes, it is true we are small 
frie, but they can still get a judgement against any company using those 
copyrights if they so chose.
So in the end the thing to do is apply for permission. If you can not 
get the consent try something else with less copyright attached.
Usually, though most companies will leave a company alone if they are 
designing materials without charging for it.
