I don't see the need for number 3. I think it should be deleted. If any
admonishments are important enough to be saved, the discussion should be
on list and open to all Members.

I would remove these and replace them with:
3. If the Members come to a consensus that another Member is abusing his
or her list posting privileges, then the Members may choose a delegate
to formally warn this offending Member to cease these abuses.
4. If the Members come to a consensus that another Member who has
previously been warned is continuing to abuse his or her list posting
privileges, then the Members may ask the Listowners to ban the offending
Member.
5. When it is impossible to form consensus on a subject, a vote of all
Members, including Listowners, may be called if requested by a Member
or Listowner and accompanied by a petition of at least 10 Members or
Listowners. The request and petition should include:
a) a statement of the matter to be decided by vote
b) the logistics of how the vote will be handled
c) who will officially report the results
d) what numerical outcome is necessary for the vote to be decided
definitely, which as a minimum should be at least 20 Members or
Listowners casting a vote
e) the time period of the vote, which should be at least 7 days
