IMHO drugs don't fall into the category of moral laws, they fall into the category of health and safety laws. Right up there with the laws against serving raw chicken.
Now, why aren't cigarettes illegal, I dunno, health wise they probably should be. The Constitution claims that one of the jobs of the Federal Government is to promote the general welfare.
