I don't see it that way in this case.  The public schools would only
be taking federal dollars *if* they could convince the parents that
they had the best system for their kids.  I think the fed could create
minimum threshold standards but beyond that it should be by choice.

The difference here would be that nobody is forcing Kid Y to go to
school X as it is with the public system; that kid can go anywhere she
wants.  Therefore whats fair is that she have the choice on where to
go.

If a school, public or private, creates rules that everybody agrees
suck, then no kids will go there and the school will die.  That's
plenty fair.
