What if she WAS a menace to society? What if her crime was kidnapping or
murder? I guess my point is that the law needs to be clearer when dealing
with these types of situations, where a criminal becomes the victim.

I think it's obvious in THIS case that incarceration probably wasn't the
correct move...but are there certain offenses where maybe it would have
been?

It's a valid consideration.
