Ok, I think your examples are a little silly, but I'll play along.

> If your hypothetical woman went to a frat party and lay down in the living
room with her legs spread while fondling her breasts what do you think would
happen?

A LOT of cheering and flash photography.

> Would that be rape?

Abso-fucking-lutely it is.

> Is what she did wise?

No, but wisdom isn't a pre-requisite to being a victim.

> Is it a recommended course of actiom?

No, but it doesn't make her any less a victim.

> Would you suggest it to your daughter

Absolutely not. However it still doesn't diminish the crime.

> girlfriend

Shhhh, my wife might be reading.

> or sister?

Actually she could probably use a little action. haha.

> Is it still rape?

Absolutely.

> Would her behavior be a factor in the decision not to prosecute?

Absolutely. The DA makes decisions based on whether a conviction would be
forth-coming. NOT whether a crime was committed. So it's a bit of a
disingenuous point you make.
