If someone stands on your property and does not impede you or bother you in any way..who is the victim? How is that a crime, but driving a vehicle under the influence is not - at least nit until you are involved in an accident.
Driving is a privilege, NOT a right. A privilege that can be revoked if you do not follow the rules. You right to 'free passage' or whatever you want to call it would not be infringed as you would still be able to walk, ride a bike, etc. If you let someone drive who was a .08, in my mind, you are equally as culpable as the person driving should they be involved in an accident.
