If you have made the decision to remove a government from power, then you no longer recognize that governments laws, therefore it is not illegal.
Government derives its power from the consent of the governed. If the people no longer give consent, then the government no longer has power. In the US the idea is self rule, the government is there to provide structure and prevent anarchy.
