Right, so why is there a license deamon running in the background then ?
It specifcaly says that this deamon will 'perodicaly check', incidently, on 
page 9.

No, it says "to prevent against aciddental deletion of the license".
There is no need to place it outside the file system to achieve that *at all*.
I am totaly unconvinced by 'a decade of research and testing' - how was that 
split ? Why does no one else do that ? Why did that last company to use this 
tech. give it up as a bad idea ?
It's bad enough that earlier versions of CF dumped that weird file in /etc/ 
:-)
