As far as I am aware, if someone has not concented to having themselves
as a referee and have not given you a reference, they can say whatever
they want about you.

I wish it was so, actually you are partially right, when I first asked
for a reference I was told exactly what you just said "They don't give
out references" however company B insisted on a reference, so I gave
them a contact number. and this contact gave a reference after all,
although it was a bad one..
