Yes, criminal prosecution would occur AFTER he leaves office, however he
leaves office, and that is what my question addressed. The Constitution
forbids pardon in the case of impeachment, as MJ cited. If he is removed from
office Gore could pardon him as his first presidential act, or if he completes
his term, Gore, if elected, or whoever the new president might be, could
pardon him as his or her first act. My point is that he sure could use a
pardon from somebody. Question is, where is it going to come from?
