I first heard this question raised late last week on some talkshow or
other...it raises an interesting point....

The Constitution doesn't really spell out THIS conundrum...apparantly
Andrew Johnson never got around to appointing a new VP when he assumed
the presidency after Lincoln's assassination, so the issue never arose in
1868....we're tilling new ground here with the Clinton impeachment...

As I said, the Constitution doesn't state one way or the other what the
VP's role in the Senate trial would be...but as the person who presides
over the Senate, it would SEEM that he'd have some sort of role in an
impeachment trial, even to the point of casting a deciding vote in the
off-chance of a tie vote...

But since it's obvious that whichever way the vote goes, the VP has a
personal stake in the outcome, it's hard not to imagine a challenge to
him partaking in his traditional role on the basis of conflict of
interest...
