It is my understanding that a work is copyrighted automatically, copyright notice or not, as soon as it exist on any transfer medium (i.e. not just in my head).
Confirmed by Al Schlessinger (the top formost authority on the subject).
The copyright notice that we present includes a license for use.
We (the Apache Software Foundation) retain ownership of the code, and license it to our users. We happen to have a liberal license while others are more restrictive (and much longer).
