Sounds like a totally different issue, normally referred as Trademarks.
"Apache" is not a registered trademark for the ASF. You will notice the lack of "TM" or "SM" in the logos :D

probably, since Excel is not a registered trademark, you could release software called like that. In the case of a spreadsheet application, you'll probably get sued, because you're deceiving your buyers, lifting on the marketing budget of MS, etc etc. In cases like this, the one with the most lawyers often wins.
