trademarks don't have to be registered to be trademarks. Registeration only 
gives more weight but non-registered are defensible if certain conventions 
are followed (ie you have defended and enforced historically or this is a 
first violation).

You couldn't without violating a trademark (regardless of whether it is 
registered or not but I assume it is).
