Which I think is correct, I could be wrong here as I was not directly involved in the process but: I believe what happened was: 1. Adobe donated the Flex trademark to Apache (but not the logo?) 2. Apache registered "Apache Flex" as a trademark. From my reading of the rules Apache have more of an issue with "Apache Flex" in a domain name than "Flex", but you may be able to get permission as long as the intent is clear and right disclaimers etc are in place.
