Are you telling us that mailing lists do not make the difference between a
hard bounce or a soft bounce? This seems like a bug to me.

Um, you might want to read the DMARC spec.

15.8.  Rejecting Messages

   This proposal calls for rejection of a message during the SMTP
   session under certain circumstances.  This is typically done in one
   of two ways:

   o  Full rejection, wherein the SMTP server issues a 5xy reply code
      (550 SHOULD be used) as an indication to the SMTP client that the
      transaction failed; the SMTP client is then responsible for
      generating notification that delivery failed (see Section 4.2.5 of
      [SMTP]).

   o  A "silent discard", wherein the SMTP server returns a 2xy reply
      code implying to the client that delivery (or, at least, relay)
      was successfully completed, but then simply discarding the message
      with no further action.

Do you ssee a soft bounce in there? I suppose the silent discard is relatively harmless, but if your mail is going to be thrown away anyway, why bother to send it?

Now, more factual, I read this doc
(http://www.esosoft.com/support/mailinglist/mailman/bounce.html) a few
weeks ago, and mailman seems to consider as a hard bounce, any bounce it
does not recognize, this seems to me poor design.

If you want to tell the people who maintain Mailman that their software, which works just fine in a bazillion installations, has to change because of our latest FUSSP, well, try it and let us know how it goes.

Really, if you want to participate in mailing lists, it's your responsibility to do so in a way that doesn't screw up the lists for everyone else. If I found people bouncing off my lists due to subscribers who publish overstrict DMARC policies, the solution is to remove the offending subscribers from the list. I don't think my position would be unusual.
