There are in general 3 positions: - Its not my concern... the rules are OK. - Its (for license) a typical Belgium problem, go and discus with them (I do this already 9 months with the BIPT, no dialog possible). We (US ++) have not this kind of problems. - Problems mentioned are real... It cost a lot of money! Before I go on let me give a short example on how good our Belgium authorities (BIPT = Belgium Institute of Post and Telecom = FCC) are: 1. As mentioned before, once you have a license you have to agree and to allow a "visit" of your facilities all around the clock. 2. The BIPT gives licenses on behalf of the Minister of communication and are able to withdraw those (this seems logical to me). PRACTICAL APPLICATION: (by the way it didn't happen to my facility) A CB store close to Brussels is "visited" by the CNS (dept. of BIPT) and police without any official authorization (droit de perquisition) with 6 people in total on a simple complain from "mister anybody". Store and personal belongings are "visited", owner is also radio ham. Equipment is carried away composed of: - CB transceivers certified in France but not to the typical Belgium rules (equipment for export). GUILTY! - general linear power HF amp used for Ham radio. GUILTY, can be used on CB equipment. - Ham transceiver covering the 144 - 146 MHz band for ham radio, manipulated by front panel actions by CNS inspectors. After manipulation the frequency range is changed to 144 -148 MHz operation. GUILTY, outside allowed radio ham band! - other equipment including dummy antenna, etc.. Note: They tryed to put a spectrum analyzer in receive mode only in order to prove it is possible to receive outbound frequencies, but didn't succeed. CONSEQUENCES. The LICENSES of the owner are withdrawn prior to any legal (court) action. The store was no longer allowed to sell equipment's without licenses (Ruined + cost of lawyers)! They even made a second "visit" in order to check! By the way, the court conclude to NOT GUILTY conditions (legal and financial) in view of circumstances and already spend cost. The law admit the BIPT to withdraw licenses isn't it? I know its possible to go true court again and spend money with lawyers.. Someday you can open the business again probably! Above is maybe beside the EMC question but the position of the monopolistic rule making people is similar. They estimate they have all the rights to make rules without any justification if they are required or not. Why do our BIPT add license constrains based on a laws who is outdated. Who has to propose a change to the outdated law's? The BIPT again. Do you cut the tree in which you are seated? Why are European rules different, are the other country's stupid or is the purpose only to justify their job? The good fellows!!! We pay them. Of course you don't have (maybe) the same "side" constrains as we do but the main constrains of CE rules are applicable to everybody and how is this burden justified to you?
