I would like to agree with you in principal, but I have a problem doing it in practice. When we sent our CB reports to other countries to get our products approved there, some agencies told us that the report had to list IEC 60065 and not EN or UL 60065. Then we also had to make sure the country specific deviations were included. So while in theory you are right about being able to use any method as long as you document it, in practice some other country agencies will not accept the practice. At least from my limited experience. A DoC is a declaration that a product meets "essential requirements" of the directive not conformity to any particular standard Standards published in the OJ for the LVD only give presumption of conformity to those "essential requirements", they don't absolutely have to be used. If one so chooses, one may construct a product to the "essential requirements" without actually using a harmonized standard. In this case, the methods used to assess whether or not the product conforms to the essential requirements of the directive, must form part of the technical construction file and be available for review. I am not personally familiar with UL60065 but if UL did their homework properly, then the CB report that you mentioned should cover any differences between the UL and EN versions of this document ( well, presuming that you told them all your intended markets) If that is the case, then I really don't see a problem in making a declaration listing either standard. Just document what you did.
