Rob, Thanks for the explanation. I have gotten out of focus pix like you described but not just with the 28-135 - turned out, in my case, I was using the what is called as "release priority" mode (AI Servo) where the shutter releases even though the camera may not be focussed. (See Chuck Westfall's comments here: http://photonotes.org/other/ai-servo.html ) Also, since I have set my CF4 = 1 I can now take pictures regardless of whthere it is in focus since the focus button is now the * button and not the shutter release button. FWIW, IMO the lens motor on the 28-135 a darn lot better than most non L lenses - it is a ring USM. My sample snaps to focus almost instantly every time, provided there is enough light (or using AF assist) and subject is within focusing range.
