It is one archetype for military sf backgrounds, to try to come up with an enemy, where a military model the author likes, happens to be ideal to fight such an enemy.

So what could that be for prison regiments:

Drones and robots should not work well, maybe the enemy has superior EMP abilities.

Sticking to procedures and complex tactics should not be neccessary.

Holding a position and not routing should not be neccessary.

Winning hearts and minds should absolutely not be neccessary.

The first i could come up would be, that the enemy has superior comando units, who do guerilla warfare. The enemy has few of them, but they are so good, that the best human* commandos are not on their level. So the human empire send in prison regiments to be slaughtered by them, hoping that if they send so many more soldiers, eventually there will be enough losses among the enemy commandos.

If there is enemy population (or population the enemy feels respnsible about) and the enemy has an appropriate code of honour, prison regiments and the attrocities they eventually commit can serve to draw the enemy out of fortified positions. If there is some space UN, it might be, that it is not political feasable to have attrocities as stated policy, but you can get away with incompetent troops, as long as execute some offenders from time to time, to show your good will in trying to reign them in.

If the latter aspect is correct, you need a hell of an explaination, if you want the human empire to have white hats. But you could have an enemy, who is worse and therefore acceptable to fight, and the pcs are either wrongly commited or criminals with a code of honour or reformed criminals and face the three problems of fighting the enemy, protecting the enemy civilians from their comrades and being considered expendable by their own side.
