I'm not sure that giving the client a choice on whether they want to see the MOTD or not is an answer as most will probably say no as they just want to play.
What if, after a few returns to the same server, a notification is displayed to read the rules of the server which they must do and agree to to continue playing on the server. I'm all for limiting the abuse, but there are a lot of servers that use MOTD for good and not bad.
