I have a different take on this.  We aren't talking about persons; we're
talking about businesses. Innocence doesn't figure into it.  Both sides
will stretch the law as far as they can to achieve their business goals.
Standard business practice.  And concepts of "right or wrong" (if such 
concepts have any meaning here at all) will be buried in legal wrangling.

I think when legal action is pending "Caveat emptor" should be stressed.
The customers and potential customers are not served well by the current
situation.
