Steve Jobs always made it clear when the iPod was released that it was the user's responsibility to uphold Copyright, and that the iPod was protected to stop most people copying music from 1 Mac to another, but any determined person would get around it without a problem - as if they couldn't circumvent it 1001 other ways anyway...
I think it strikes the right balance between protecting one's work and trusting the consumer. Blank cassette tapes did not spell the ruin of the music industry, and neither will the occasional person copying their iTMS purchased songs onto a sampler for their friends. That is not, nor ever really has been, the problem.
Exactly the attitude Apple have.
The problem has been the ability of a person sitting at home with a modestly powerful computer to propagate literally thousands upon thousands of pristine copies of this material illegally, and even make profit from doing so. That scale of criminal activity is worth the RIAA's time and money to prosecute.
I won't shy away from the fact I think the music industry overcharges for CDs, but on the same count I still buy them to stay on the right side of the law. I mean I bought a whole CD of R.E.M. MP3s at a fair once, but now I own all the albums I have them all as 192kbps AACs I may as well throw it away...
I do believe copying music many times to 10s or 100s of people without paying royalties is wrong. I don't generally get asked for copies of stuff, but if I do I only let 1 person have a copy, if lots of people ask I say 'buy it'.
