I think it's a darn shame, it proves that Java might be open source but it is NOT free. It's clear that if Apache Harmony had trouble getting recognized as Java with Sun, they certainly have no chance in hell with Oracle given the law-suit against Google/Android. It's bully tactics and it's a crying shame to do this to Apache, the single largest non-profit org that I can think of, responsible for driving Java where it is today.
