I will defend Kohsuke. Kohsuke started the project on his own time in 
California. It was only after Sun recognized what he'd been doing that they 
suggested he start working on it on Sun's dime. Under those conditions, 
Oracle's ownership of Hudson (the name and trademarks etc.) is some what shaky 
because it is my understanding that under CA law, work done on your own time 
cannot be claimed by your employer. The only thing that has kept Kohsuke from 
going after Oracle is the same reason why many people abandon when faced with 
doing battle with a major corporation, they don't have the funds to pay the 
lawyers needed to fight the claim. There are some hints of all of this in an 
older posting on Joe Ottinger's blog about this.

It is my opinion that Oracle wanted rid of Kohsuke as he wasn't someone that 
they could control and yet he wielded considerable influence over the 
community. So, Oracle bungled it and lost... so far. Bringing it to the EF 
might change that as the EF might bring legitimacy and distance that is needed 
to turn things about.
