I have requested photos from Find-A-Grave many times and everyone I have asked has enthusiastically granted permission. I too give credit to the photographer in my citations after I read something that Thomas MacEntree wrote about it. This is what my citation looks like:

When I add findagrave records, I say "Record submitted by" and the name. I record what they've submitted and then add the URL. Of course, I'd love to have that photo for my files, but I just record that a photo has been added and by whom. I've searched findagrave and found where they alow snipits of partial information to be submitted onto memorials, but didn't find anything about taking snipits from a memorial. Thanks to Tim for the "Copyright Fundamentals for Genealogy" URL. Here's an example: "copies the pages and posts small, significant portions from them online". This comes under the "fair use" copyright law. I don't know them, so I would suggest that you read them. Copyright of an image usually belongs to the photographer (for a long, long time), but this may have been passed to FindaGrave, who could then apply their own conditions for reproduction.
