Marbury vs. Madison which states that anything (law, act of congress,
executive order, etc.) which is contrary to any part of the
Constitution is AUTOMATICALLY null and void without the need for
judicial review.
Congress alone has war making powers. The President doesn't have the
authority to send a single troop into battle for a single day without
a formal declaration of war by Congress. Congress may only declare
war when it is in the "common DEFENSE" of AMERICA....not Kuwait or
anyone else. The role and scope of the U.S. military is for defending
America.
If you don't like it, or you think it turns you off to libertarianism,
that's ok.
Also, using the Navy to repel Pirates, is considered "defense" and
does not require a declaration of war, because declarations of war are
made against nations, not a group of pirates.
Korea, Vietnam, Panama, Bosnia, and both attacks on Iraq were all
unconstitutional.
