I feel that one of the most important reasons for this is strategic in nature. Some of the large software patent holding companies do not want to create bad news about software patenting before they have the legislation supporting them that they want in all industrially-important venues. Thus, I believe that the final approval of software patent legislation in the EU will be followed by a rash of software patent lawsuits.

Patent lawsuits against Open Source developers are not necessarily expensive. The developer does not have deep pockets and will generally have to settle early in the process.
