With that battery, I would say lying it flat would be a problem. It does not look sealed.

Even with a sealed battery having them laying in different orientations can cause an imbalance. However, with sealed batteries I would not worry about it as long as you have a decent charging scheme and are careful not to discharge the batteries to the point that you might reverse a cell.
